Patrick and Bruce, Per our discussion this morning regarding the pond and subsequent easement(s) on the northeast quadrant of CSAH 83 and Sunwood Dr., historically Anoka County has worked with both the City and developer to relocate the drainage ponds should there be a desire for development purposes. We can certainly add some language in the TH10 and Armstrong Joint Powers Agreement (JPA) stating something of that nature, but it should be noted that Anoka County has relocated dozens of ponds in the past for development purposes and simply work thru the process with the developer and the development review process. Here is some potential language for the JPA, should it be necessary. "Anoka County shall work in good faith with the City should there be a desire in the future to relocate Pond ? for the purposes of development. The County will need to ensure that our drainage interests continue to be protected by means of an easement(s) for both the new pond location and the storm sewer conveyance system. Relocation of said easement(s) shall occur at no cost to the County." Feel free to provide comments. Otherwise, I hope this will suffice. Andrew J. Witter, P.E.
