I <br /> <br />I <br />I <br />I <br />I <br /> <br />Commissioner inquired if dedication of park land applied in this case. <br /> <br />Mr. Dom replied that with a PUD, if 20% or more of the land is used for <br />public purposes no park land dedication is necessary. <br /> <br />Commissioner Schneider inquired if the money obtained from the sale of park <br />land would be deposited in the City Park Fund. <br /> <br />Mr. Schnelle replied that it wo~ld be. <br /> <br />Motion by Commissioner Schneider to recommend preliminary approval of Mr. Bill <br />Dorn's proposed planned unit development based on the findings of fact <br />and the recommendations of City Engineer, City Staff and Planning and Zoning <br />Commission. <br /> <br />Commissioner Deemer seconded the motion for further discussion. <br /> <br />'1 <br /> <br />Further Discussion: Commissioner Deemer stated that the motion should include <br />wording to the effect that the sale of the City property'shall hot be for an <br />amount less than that to be the determined worth of the property at the time <br />of it's donation to the City as park land. <br /> <br />Commissioner Schneider amended her motion to included that wording. <br /> <br />I <br /> <br />i <br />I <br />I <br />I <br /> <br />Commissioner Deemer seconded the amendment to the motion. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Kennen, Zimmerman, <br />Deemer, Schneider, Isakson and LaDue. Voting No: None. <br /> <br />Case 03: Proposed Critical Area And Wetlands Ordinance: <br /> <br /> Peterson noted that a Variance Procedure should be added to the <br />Ord in the case of Mr. Martin, if present conditions continue to <br />exist ,lanning and Zoning Commission goes on record as recommending that <br />Mr. Martin allowed furture subdivision into two lots. <br /> <br />Commissioner <br />were answered by <br /> <br />der inquired if Mr. Martin felt secure in that his concerns <br /> ~lanning Commission. <br /> <br />Mr. Martin replied that accepts P&Z's interpretation of the ordinance. <br /> <br />Commissioner Schneider that Mr. Martin review of the minutes of <br />this meeting and that he also City Council with his concerns. <br /> <br />Mr. Schnelle noted that Mr. Martin's <br />meeting will be included in the Councl <br /> <br />presentation sutznitted at this <br /> <br />I <br />I <br /> <br />Commissioner Schneider stated appreciates Martin's feasible problems <br />regarding a tract of land along 139th but con~ Mr. Martin does own <br />additional adjacent acreage, at this point she s not want to go on record <br />as being in favor of granting Mr. Martin a ~or future subdivision. <br />Commissioner Schneider stated that she is in favor procedure <br />being included in the ordinance. <br /> <br />Mr. Schnelle stated that Mr. Martin should be able to have more than two, <br />but at least two lots from that tract of land. <br /> <br /> <br />
