I I -4- cost of much improvements as estimated by the City Engineer, including the estimated expense of the City for engineering and legal fees and other expenses incurred by the City in connection with the making of such improvements. In lieu of a cash escrow deposit, the subdivider may furnish a letter of credit or security acceptable to the City in a penal sum equal to one hundred fifty percent (150%) of the total cost of such improvements as estimated by the City Engineer. 3. The making and installing of all the improvements required by the terms and conditions set forth by the City within one year; Satisfactory completion of work and payment therefor, which work was undertaken by the subdivider in accordance with the developer's agreement referred to above; and 5. The payment by the subdivider to the City of all expenses incurred by the City. 170.039I CONSTRUCTION PLANS (ALL DEVELOPMENT AREAS) Construction plans and specification for the required improvements conforming in all respects with the code and ordinances of the City shall be prepared at the expense of the subdivider by a professional engineer registered by the State of Minnesota. 170.039J INSPECTION (ALL DEVELOPMENT AREAS) Ail required improvements shall be inspected during the course of construction by the City Engineer. 170.039K PRIOR IMPROVEMENTS Improvements for final plat approval or execution of the performance contract shall be accepted as equivalent improvements provided the City Engineer approves the same. 170.039L CONSTRUCTION BY CITY The City shall have the right to install such of the required improvements as it may elect. 170.039M WARRANTY The City shall require a warranty/maintenance bond for one (1) year following the final acceptance of any required improvements. 170.039N AS BUILT PLANS Two copies to be filed with the City.
