'1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> <br />-4- <br /> <br />cost of much improvements as estimated by the City Engineer, including <br />the estimated expense of the City for engineering and legal fees and <br />other expenses incurred by the City in connection with the making of <br />such improvements. <br /> <br />In lieu of a cash escrow deposit, the subdivider may furnish a letter <br />of credit or security acceptable to the City in a penal sum equal to <br />one hundred fifty percent (150%) of the total cost of such improvements <br />as estimated by the City Engineer. <br /> <br />3. The making and installing of all the improvements required by the terms <br /> and conditions set forth by the City within one year; <br /> <br />Satisfactory completion of work and payment therefor, which work was <br />undertaken by the subdivider in accordance with the developer's <br />agreement referred to above; and <br /> <br />5. The payment by the subdivider to the City of all expenses incurred by <br /> the City. <br /> <br />170.039I <br /> <br />CONSTRUCTION PLANS (ALL DEVELOPMENT AREAS) <br /> <br />Construction plans and specification for the required improvements conforming in <br />all respects with the code and ordinances of the City shall be prepared at the <br />expense of the subdivider by a professional engineer registered by the State of <br />Minnesota. <br /> <br />170.039J <br /> <br />INSPECTION (ALL DEVELOPMENT AREAS) <br /> <br />Ail required improvements shall be inspected during the course of construction <br />by the City Engineer. <br /> <br />170.039K <br /> <br />PRIOR IMPROVEMENTS <br /> <br />Improvements for final plat approval or execution of the performance contract <br />shall be accepted as equivalent improvements provided the City Engineer approves <br />the same. <br /> <br />170.039L <br /> <br />CONSTRUCTION BY CITY <br /> <br />The City shall have the right to install such of the required improvements as it <br />may elect. <br /> <br />170.039M WARRANTY <br /> <br />The City shall require a warranty/maintenance bond for one (1) year following <br />the final acceptance of any required improvements. <br /> <br />170.039N AS BUILT PLANS <br /> <br />Two copies to be filed with the City. <br /> <br /> <br />
