4. Development Plans. The DEVELOPER shall develop the Plat in accordance <br />with the following plans. The plans shall not be attached to this Agreement, but are in CITY <br />files. The plans may be prepared by the DEVELOPER, subject to CITY approval, after <br />entering into this Agreement but before commencement of any work in the Plat. If the plans vary <br />from the written terms of the contract, the written terms shall control The required plans are: <br /> <br />Plan A - Final Plat (dated March 25, 2004 subject to revisions per City Staff <br />Review Letters dated April 15, 2004 and April 23, 2004) <br /> <br />Plan B - Street, Utilitiies, Grading and Drainage Plan (dated March 25, 2004 <br />subject to revisions per City Staff RevieW Letters dated April 15, 2004 and April <br />23, 2004) <br /> <br />Plan C - Landscape Plan (dated March 25, 2004 subject to revisions per City Staff <br />Review Letters dated April 15, 2004 and April 23, 2004) <br /> <br /> 5. Stage I Improvements Required. The improvements the CITY requires the <br />DEVELOPER to construct within the Plat are as follows: <br /> <br />g. <br />h. <br />i. <br /> <br />Trunk and lateral sanitary sewer system <br />Trunk and lateral watermains and appurtenances <br />Public streets with concrete curb and gutter <br />Private streets with concrete curb and gutter <br />Trunk and lateral storm drainage facilities <br />Lot grading and permanent erosion control <br />Landscaping <br />Trail Construction along Ramsey Blvd. <br />Sidewalk Construction along Peridot St. NW, Olivine St. NW, and 146th Ave. <br />NW <br />Natural gas <br />Telephone service <br />Electric service <br />Street lights (installment arranged by the CITY during Stage I Improvements and <br />paid for by DEVELOPER as Stage II Improvement) <br /> <br />("Stage I Improvements") <br /> <br /> The DEVELOPER agrees to construct the Stage I Improvements according to the terms <br />and conditions of this agreement and in accordance with DEVELOPER's plans submitted to the <br />CITY. Said plans shall be in conformance with the Grading Plan dated March 25, 2004, Utility <br />and Street Construction Plan dated March 25, 2004, all prepared by URSInc and the <br />Landscaping Plan dated March 25, 2004 prepared by Close Landscape Architects. All of the <br />DEVELOPER's plans are subject to revisions per City Staff Review Letters dated April 15, <br />2004 and April 23. 2004.
