He said in order to do this, an easement would <br />have to be obtained. <br /> <br />Attorney Goodrich and Engineer Raatikka indicated there would be no problem in <br />extending the street. <br /> <br />Attorney Goodrich was directed to check with the landowner to see if he would dedicate <br />an easement for this street to the City of Ramsey. <br /> <br />Mayor Cox said if there is some way to achieve this so the bus can get through, it <br />would not have to be more than a rough road. <br /> <br />Payments of 153rd Easements <br />Attorney Goodrich indicated he had questions regarding 153rd easements and the way <br />the matter was handled. He said he was not consulted in the matter and that Mr. <br />Walker had handled the entire easement acquisition. Therefore, he asked for Council <br />approval to send out the checks. <br /> <br />Motion by Reimann, seconded by Gorham to pass Resolution #19 on 153rd Avenue N.W. <br />Construction Project 75-1, to pay the property owners for easements. <br /> Carried 5 Ayes <br /> <br />Engineer Raatikka presented a bill for payment on Project 76-1. <br />Motion by Councilman Reimann, seconded by Councilman Mickelson to pay NDH Inc. <br />$77,637.39 with 10% retention of monies until completion of the project. <br /> Carried 5 Ayes <br /> <br />Engineer Raatikka said easements on Project 76-1 were given to Mr. Walker to handle <br />and he indicated he had obtained them. Titles were given to Attorney Goodrich to <br />research. <br /> <br />Attorney Goodrich was directed to follow up on easements on 76-1 Project. <br /> <br />Engineer Raatikka reported that Mr. Dennis Leikvold, (Project 75-1), wants to get <br />paid for his trees, plus he said his septic tank was taken out and he wants reimburse- <br />ment for that also. However, he and the contractor had checked this out and they were <br />not able to locate a septic tank, they even dug down with a backhoe trying to locate <br />it, but it was not there. <br /> <br />Mayor & Council Input. <br />Mayor Cox asked Attorney Goodrich for an update on the lawsuits. <br /> <br />Attorney Goodrich reported that the Oliphant associated lawsuits, writ of mandamus <br />lawsuit is dismissed. Mrs. Nelson case is still pending and will be tried after the <br />first part of December. The Oliphant versus Mrs. Guy case was received but found not <br />to be worth trying. The plaintiff now is filing conspiracy charges against four <br />Council members. <br /> <br />Mayor Cox commented that through negotiations, the City is able to participate in <br />Community School Programs with a levy of $1 per capita, with the cost b~eing shared <br />1/3 by each, municipality, school district, and independe~l~t-' activity Tees, with <br /> <br /> <br />
