Carson brought in a new plan for <br />cons~ideration which essentially eliminated proposed commercial area <br />and the e;~st area of the original sketch plan and development. . <br />Mr~ Carson requested only residential rezoning on the west side of the <br />~ubject property. Mr. Carson agreed to waive the 45-day time limit <br />of zoning ordinance 73-6 and specifically Section 8.5. The Council <br />will have ~i. ts staff review the proposed change with re~ard to legality <br />of proposed adjustment as it relates to the published notice for the <br />or].ginal Yezoning hearing. The matter will be referred to Planning and <br />Zoning for review and consideration of the new sketch plan to be <br />p~esented. No formal action was taken on this matter. <br /> <br />Recess: The Council recessed from 9:28 p.m. to 9:39 p.m. <br /> <br /> A1 Bu]]ick Variance: Mr. Bullick submitted a formal written variance <br /> ~/e~-d~-s:~[~'~-:~]~i~-~-5~il. The ma~ter generally refers to his p'~oposed <br /> Riverside West subdivision. The specific variance requested was to <br /> allow a metes and bounds transfer of a parcel of land shown as Lot <br /> Block 2~ on ~aid Riverside West map. The specific tract considered <br /> consists of approximately t 1/4 acres. The specific variance requested <br /> was a var:iance from section 12.01 entitled Restrictions on Filin~ <br /> and Record:lng of City Ordinance 75-5. Mr. Bullick stated that h <br /> had requested approval of Riverside West in April~ that to date ne <br /> had not been given said approval~ either 'by the Planning Commission <br /> or the City Council~ that he had sold on a purchase agreement the <br /> above de~cribed trac'c of land and that if he was not able to convey <br /> it~ the purchase would fall through. He indicaLed LhaL this would <br /> be a financial hardship to himself o The Council found that this <br /> would be a hardship Zo Mr. Bullick~ Mr~ Micketson moved the :foil. owing: <br /> that ~:he va~:.[ance be granted as requested contingent upon the fo]lowing: <br /> (1) That '~he applicant provide to the City a public access easement <br /> 66 feet in width which easement runs along the west side and <br />'sou'cheast side of the parcel from through State Highway 10 and said <br /> easement is indicated on the proposed plat of Riverside West (2) That <br /> an escrow account in the amount of $4,000 be established by the <br /> developer with the City which $4,000 escrow is to guarantee construction <br /> of an adequate access as described in (1) above; (3) a site pi. an is <br /> · ~o be presented to the Planning and Zoning Commission and app'roved <br /> by the Planning and Zoning Commission (4) That the granting of this <br /> variance and its contingencies in no way cor~its the City Council to <br /> accepi: or a~ree to the proposed plat of Riverside West.
