-2- <br /> <br />fact to Mr. Russell and he was aware of it and agreed to put $3,000 <br />of Class V on these roads. The Township had completely covered the <br />older roads before this with Class V at Township cost, in this de- <br />velopment. Some of the newer roads were not ditched, had no cul- <br />verts, etc. We had indicated we would go ahead and permit our <br />equipment to go over there and put the Class V on these roads. If <br />Mr. Russell puts Class V on these roads, I would be willing to send <br />our equipment over to blade out this Class V some time this summer. <br />It costs a lot more money to assess this cost back to the property. <br />The County Attorney advises us we would not have any right to spend <br />any money over there in view of the fact that this area is in And- <br />over City. We could, by an agreement with Andover, send our equip- <br />ment over there. <br /> <br />Mr. Reimann told Mr. Russell that when he built this development, <br />he had the responsibility to build the roads there. <br /> <br />Mrs. Oliphant asked Mr. Russell if he was going to fix these roads. <br />Mr. Russell replied that his attorney had advised him not to do it. <br />Mrs. Oliphant asked him why he didn't go thru with his agreement <br />with the Township. Mr. Russell said he had gone to see his attorney. <br />Mrs. Oliphant asked Mr. Russell if he was a man of his word. Mr. <br />Russell replied he hadn't had time to talk to his attorney. Mr. <br />Russell said he had been under duress when he had made the agree- <br />ment. Mr. Babcock asked him what kind of duress. Mr. Reimann said <br />the duress was from the people he had sold the lots to. Mr. Bab- <br />cock said Mr. Russell was trying to turn this situation around in <br />an effort to get out of doing what he had agreed to do. <br /> <br />Mr. Schneider asked Mr. Russell how he would feel if they fixed the <br />roads and then assessed it back to the property owners. Mr. Russell <br />said he still owned half a dozen lots. Mr. Russell thinks it would <br />be fair to have these roads fixed and assessed back to the property <br />owners. <br /> <br />$3~,000 still will not bring the roads up to standard at present day <br />prices. Mrs. Oliphant asked if Mr. Russell would put up the $3,000 <br />and Andover pay the difference and then assess it back to the pro- <br />perty. Mr. Russell said he wanted to see his attorney. The pres- <br />sure Mr. Russell is under is from the people who live on these roads <br />and who are complaining about the condition of the roads. <br /> <br />Mr. Rither feels Andover is sort of an innocent bystander here. He <br />said it does come under the jurisdiction of Andover now. They still <br />want to get the problem resolved satisfactorily. Mr. Rither asked <br />Mrs. Oliphant if she didn't feel that in order to have friendly re- <br />lations between Andover and Ramsey that Ramsey should bring these <br />roads up to standard. Mrs.Oliphant said we could make a contract <br />in writing with the two cities. <br /> <br />Mr. Cox stated that Ramsey was concerned or they would not'have <br />brought the matter up with Andover when we were over there for the <br />meeting or even be here tonite.
