Mr. Schulte replied he pushed for extensive trees. He would also look at some segmer~ts of <br />fencing with trees with Ryland. He stated he wants this to look as good as possible. <br /> <br />Mayor Gamec commented the City has some sound walls on Highway 47 and they have learned <br />fi'om their mistakes. Highway 10 should have something attractive. Plantings, trees, and <br />berming could be utilized. <br /> <br />Mr. Schulte indicated he would like to do more berming and would have to talk to the City <br />Engineer about changes in the slope. <br /> <br />Counci hnember Elvig stated the two concerns are the footage and how they protect themselves as <br />a City. The owner should not be able to come back and request a taller wall. <br /> <br />Councihnember Strommen noted they have gathered data and addressed the concerns. <br /> <br />Associate Planner Wald suggested a sum paragraph be included in the development agreement <br />regarding this and to require the developer to include this in the covenants as well. <br /> <br />Councihnember Kurak commented vegetation is pretty, but it does not cut down the noise. She <br />lives I ½ miles fi'om Highway 10 and can still hear the freeway. <br /> <br />Mayor Gamec directed staff to work with the developer to determine the fencing. He stated he <br />would like to see something more decorative, but not cost prohibitive. He does not want the <br />pond hidden fi'om the road. <br /> <br />Cmmcihnember Strommen suggested an eight foot fence be constructed with the trees and a ten <br />foot fence be constructed in front of the units that are closest to the road. <br /> <br />Counci hnember Zimmerman asked if the developer will maintain the fence. <br /> <br />Associate Planner Wald replied the developer will put in the fence, and the maintenance of the <br />fence would be the responsibility of the association. She indicated in addition to the fence, staff <br />will work with the developer regarding 10 to 12 foot trees being included. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to adopt resolution #04- <br />04-093 approving the preliminary plat of Rivenwick 4th Addition noting the approved deviations <br />and contingent upon compliance with City Staff Review Letter dated March 5, 2004, revised <br />April 9, 2004. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Kurak, Pearson, <br />Strommen, and Zimmerman. Voting No: None.
