Abstaining: Councilmember <br />Kurak. <br /> <br />Introduce the 1t-1 Highway 10 Ordinance <br /> <br />Associate Planner Wald explained the Planning Commission and City Council held a joint work <br />session on March 16, 2004. During the meeting, the Commission and Council discussed how to <br />draft the H-1 Highway #10 Business District Ordinance in a manner that reflects appropriate <br />development within the corridor until such time that the properties are needed to construct the <br />highway improvements. As a result of the joint meeting on March 16th, staff was directed to <br />complete the following: <br /> · Review the permitted uses established in the B-2 District and provide recommendation on <br /> those uses that may not be appropriate in the H-1 District. <br /> · Review the building square footage allowed in the B-2 district and provide a <br /> recommendation as to an appropriate square footage reduction. <br /> <br />Associate Planner Wald reviewed the following summary of the proposed ordinance: <br /> · h'~tet~t: Confirms that the properties are in a state of transition and therefore the City is <br /> looking at providing stmadards to guide appropriate development until such time that the <br /> corridor is improved to freeway standards. <br /> · Off?cial Map: States that the City is officially mapping this corridor and references that <br /> the City has adopted an Official Map ordinance in accordance with State Statutes. <br /> · No~-Co~forming Structures: States that the existing uses and structures will be <br /> considered legal non-conforming and will be subject to Section 9.03.14 of City Code, <br /> Non-Conforming Structure and Uses. <br /> · Permitted Uses: Staff removed the following uses based on the fact that the vehicular <br /> trip generation is higher and the use typically related to the construction of a structure that <br /> is significant in size: <br /> Free standing restaurants, cafes, on and off sale liquor <br /> Private clubs or lodges serving food and beverages <br /> Motels, motor hotels, and hotels <br /> Free standing banks <br /> Fast Food establishments <br /> Gas stations <br /> Gas stations are proposed to be removed based on the fact that they require <br /> large fuel tanks to be installed underground and the City may not want to <br /> promote uses that require extra environmental care upon relocating or <br /> removing the business activities. <br /> <br />City Council/April 13, 2004 <br /> Page 9 of 33 <br /> <br /> <br />
