was originally okayed by the Council, because the City ordinance was changed over a yem' ago to
only allow a six foot fence. Chris Anderson from the City was helping another neighbor try to
find the Council minutes for that time and had no success in that. He and his neighbors feel they
should be granted an okay to install the fence since it was approved. It should be grandfathered
in as was originally approved before the new ordinance was implemented. Recently when one of
tho neighbors approached the City they were told all the neighbors on that stretch would have to
pay a fee of $600 each to have the City come out and look at the area to determine if they could
change the ordinance. Today he was told by a neighbor that Mr. Anderson said the fee could be
changed to just $600 for all of them, which they still feel is inappropriate since this was actually
agreed upon at the last Council meeting about a year ago. They are just asking the City to allow
them to put up the eight foot fence that was originally agreed upon. The fence would look like
tho sound barriers along Highway 47. He thanked the Council for their time and stated he hopes
they can resolve this here and now.

Mayor Gamcc commented the reason they probably could not find the Council minutes is
because this may have been discussed at a Public Works Session; however, it should have been
ratified at a Council meeting. He thinks they should honor what was done at the time, which
were thc eight foot fence and ihe land being given back. He noted there was no cost involved in
giving tile land back.

Mr. Rablowski explained there was not any surveying done; Mr. Jankowski and the City
Attorney determined what the legal description would be.

Thc consensus of the Council was to allow the action taken at the Council meeting when this
issue was previously determined.

City Administrator Norman indicated staff would locate the minutes from the meeting when this
issue was discussed.

Mayor Gamcc requested staff to include this issue on the next agenda if there are any problems
with proceeding.

APPROVEAGENDA

Motion by Councihnember Elvig, seconded by Councilmember Pearson, to approve the agenda.

Motion carricd.
