CASE # <br /> <br />APPLICATION FOR MOTOR VEHICLE SALES AND REPAIR LICENSE; <br />CASE OF SR AUTO <br /> By: Community Development Director Sylvia Frolik, <br /> Community Development Assistant Chris Anderson <br /> <br />Background: <br /> <br />Doug and Julie Hills own the property located at 7443 Hwy. #10 N.W. A portion of their <br />property is leased to SR Auto. SR Auto is in the business of motor vehicle sales and repair. The <br />property is zoned B-2 Highway Business and motor vehicle sales and repair is a permitted use. <br /> <br />Subsequent to a car fire at SR Auto, an inspection of the property on December 27, 2002, noted <br />violations of the Fire Code, Building Code, City Zoning Code and Anoka County Environmental <br />regulations. The violations consisted of auto salvage activities, car parts scattered throughout the <br />property (condition of premises), hazardous fluids being improperly stored, and structural <br />hazards in the building where the auto repair activities were being conducted. On April 13, <br />2004, the City Council considered an application from SR Auto for a motor vehicle sales and <br />repair license that had been placed on hold by the Community Development Department in order <br />to resolve some code compliance issues. <br /> <br />Observations: <br /> <br />On April 13, City Staff reported that all of the outstanding compliance issues had been <br />satisfactorily addressed, with the exception of the outdoor storage of the repairable autos. <br />Through the discussion, it was determined that the non-roadworthy vehicles may be kept on the <br />property in limited numbers as long as they are stored indoors or in a 100% screened enclosure. <br />City Council tabled action on the license application to allow Staff time to work with SR Auto to <br />determine what type of enclosure will be used to screen the non-roadworthy vehicles. <br /> <br />Staff has met with the property owners and representatives of SR Auto on two occasions. SR <br />Auto is proposing to construct a 55' x 55' x 6' enclosure. This enclosure will be in the rear yard <br />of the property and it will be constructed of a wood privacy fence. The new H-1 Highway <br />requirements state that outside storage areas must be paved with bituminous or concrete. SR <br />Auto and the property owners are requesting a waiver for two reasons: 1) the storage area will <br />be 100% screened and the type of surface inside the enclosure will not be visible to the public; <br />2) the property currently has no hard surface improvements and is considered lawful non- <br />conforming; the applicants state that it doesn't seem logical to pave a storage area when the <br />vehicle display area does not have to be paved. <br /> <br />The following items are enclosed for your information: <br /> <br />ao <br /> <br />Site location map <br />Diagram of storage enclosure <br />City Council meeting minutes dated April 13, 2004 <br /> <br /> <br />
