CONSENT <br /> <br />AUTHORIZE STIPULATION AND WITHDRAWAL OF ANSWER <br />ACE SOLID WASTE <br /> By: William K. Goodrich, City Attorney <br /> <br />Ace Solid Waste, inc. is registering title to its property at the intersection of McKinley Street and <br />Azurite Street. The City is the fee owner of Azurite Street which does include extra width <br />adjacent to the Ace parcel. The City and Ace have exchanged deeds previously to properly align <br />Azurite Street and now we are being asked to withdraw our answer to the waste title registration <br />action m~d permit a new legal description of the parcel previously conveyed to Ace in order to <br />match the legal descriptions. Attached is a Stipulation and Withdrawal of Answer in the Ace <br />Torrens proceeding. Both the City Attorney and City Engineer have reviewed the respective <br />legal descriptions and concur that the action requested by Ace is appropriate and is in the City's <br />best interest. <br /> <br />Council Action: <br /> <br />Motion to authorize the Mayor and City Administrator to execute that legal document titled <br />Stipulation and Withdrawal of Answer in the A3~oka County District Court File #C3-02-871. <br /> <br />CC: 05/11/04 <br /> <br /> <br />
