STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />In the Matter of the Application of: <br /> <br />Ace Solid Waste, Inc., <br />a Minnesota corporation, <br /> <br />to Register the Title to Certain Land <br /> <br />DISTRICT COURT <br /> <br />TENTH JUDICIAL DISTRICT <br /> Court File No. C3-02-871 <br /> Case Type: Civil - Torrens <br /> <br /> STIPULATION AND <br />WITHDRAWAL OF ANSWER <br /> <br /> THIS STIPULATION is entered into as of the __ day of ,2004, <br /> <br />by and between Ace Solid Waste, Inc., hereafter referred to as "Applicant", and the City of <br />Ramsey, a municipal corporation under the laws of the State of Minnesota, hereafter referred to <br />as "City", as follows: <br /> <br /> RECITALS <br /> <br /> WHEREAS, the City was named in the Examiner's Report dated June 25, 2002, as a <br />recommended Defendant and was made party to this action; and <br /> <br /> WHEREAS, contemporaneously with the preparation and filing of the Application in this <br />matter, Applicant and City exchanged Quit Claim Deeds to resolve the same issues raised in the <br />Examiner's Report regarding the City, which deeds were subsequently recorded as County <br />Recorder Document Numbers 1576733 and 1576734; and <br /> <br /> WHEREAS, pending verification of the recording of the exchanged deeds, the City filed <br />its Answer to the Land Title Summons to protect its position; and <br /> <br /> WHEREAs, the recording of the exchanged deeds has been verified; and <br /> <br /> WHEREAS, the Examiner of Titles in the Second Supplemental Report of Examiner of <br />Titles dated September 19, 2002, mandates that any legal description of Parcel 2 shall conform to <br />the description used in the Application (see Exhibit "A" for Parcel 2 legal description provided <br /> <br /> <br />
