Mayor Gamec said Mr. Ralph McGinley of the County said as far as the County <br />is concerned if a violation of ordinance is corrected when the problem <br />is noted, there is nothing that can be done. They said this will get no <br />place in court. <br /> <br />Mayor Gamec told City Attorney Goodrich to tell Mr. Otter the city will <br />go into serious discussion on the expansion after the rate increase is <br />discussed. <br /> <br />City Attorney Goodrich said he didn't want to tell Mr. Otter anyting about <br />negotiating the next two years until the Barr report is completed. He said <br />he was meeting wfth Mr. Otter at 11:00 a.m. on Wednesday, May 28, 1980. <br /> <br />Mayor Gamec said the rate increase should be kept retroactive. <br /> <br />City Attorney Goodrich said he felt if the county is not going to support <br />the city, the city is going to get no place on this issue. <br /> <br />Mayor Gamec said the County wanted the record on file to read that as far as <br />the regulatory agency is concerned, Waste Management is not in violation of <br />the contract. If a problem~ in cleared up in ten days, it is not in violation. <br /> <br />Councilman Cox noted that things are occurring at the landfill and the people <br />around it have sludg~and water ponding and the county is monitoring it. <br /> <br />Mayor Gamec said he felt the county should be enforcing these ordinances and <br />not letting them go for two or three months. <br /> <br />Councilman Cox suggested sending a letter to County Commissioner Ed Fields <br />stating the city thinks it ~s very irregular that the county would say <br />there is no violation in this case. <br /> <br />Mayor Gamec said the county told him the citizens could point out the <br />irregularities at the landfill. <br /> <br />Councilman Cox said the city should assume that the county is responsible for <br />these problem areas if there are no violations in this case. He said he didn't <br />have any problems with the county ordinance if they would enforce it. <br />He suggested sending a letter to Mr. Ed Fields regarding the city's disappointment <br />in the county's response to ordinance violations, in particular Waste Management's. <br /> <br />Discussion followed on test wells at the site. <br /> <br />City Engineer Raatikka recommended adding to the resolution to provide <br />another permanent well in the landfill area. <br /> <br />City Attorney Goodrich asked if he should tell the county the city wants <br />them to look into the sludge and ponding situation Councilman Cox was talking <br />about. <br /> <br />Councilman Cox told City Attorney Goodrich to indicate to Mr. Otter that <br />just because he has the letter from the county does not mean the city agrees <br />with it and the city is going to let the county know that it disagrees with <br />their view. <br /> <br />C/May 27, 1980 <br />Page 6 <br /> <br /> <br />
