COUNCIL OLD BUSINESS <br /> <br />1. Section 110.09 City Code (Keeping of Certain Animals in the City); <br />Case of Robert Nugent, 6165'Green Valley Road <br /> <br />City Administrator Schnelle said ~Lr. Nugent has always been cooperative <br />when city staff has been to his residence on complaints. He explained <br />that Mr. Nugent is tired of the city's harassment and feels he is being <br />singled out. <br /> <br />City Attorney Goodrich said being there are neighbors present against <br />~r. Nugent, the City Comncil should not be the judge of this matter. <br />should be settled in court. <br /> <br />It <br /> <br />Mr. Nugent said he felt he was being singled out. <br /> <br />Councilman Cox said he questioned the ordinance himself because he was not <br />aware that the ordinance stated that goats, pigs or cow cannot be <br />maintained on any parcel of land in the City of Ramsey. He said it <br />appears that anybody who has these animals is in violation of the Ordinance <br />and should have a variance. <br /> <br />City Attorney Goodrich said that is one chapter of the ordinance, but <br />there is also another chapter on having animals that are causing a nuisance. <br />He explained there is no problem unless the animals cause a nuisance and <br />it is not a nuisance unless there is a complaint. <br /> <br />City Administrator Schnelle explained that the reasoner. Nugent was present <br />at the meeting is because he thinks the ordinance is unfair. <br /> <br />Mr. Nugent said the city does not have the right to tell a person they <br />cannot farm. <br /> <br />Councilman Cox explained that the council is addressing the ordinance here <br />and is trying to address what would help the whole community. He said there <br />will always be agricultural land adjacent to residential areas. He suggested <br />individuals be advised directly of ordinance changes so they kn°w what to do. <br /> <br />City Administrator Schnelle said if the city puts them mnder, a conditional <br />use permit, they will be more aware of the ordinance requirements. <br /> <br />Councilman Cox said he would be in favor of the City Attorney talking to <br />both sides to see if they can find some common ground. <br /> <br />Mr. Nugent said he didn't smell the odor from his ten sows and he didn't <br />have air conditioning like the other houses in the area. <br /> <br />City Administrator Schnelle told Mr. Nugent the fence he put up is not <br />creating good relations with his neighbors. <br /> <br />Mr. Nugent said he was going to keep on farming and having hogs and cattle. <br /> <br />Mr. Mike Villeneuve, 6230 177th Ave. N.W. <br /> <br />Mr. Villeneuve asked the City Council if the ordinances that were broken <br />in this case were in effect at the time ~r.
