In regard to the zoning of farmland for agricultural use and changing <br />the conditional use permit requirements for livestock, the Council <br />discussed as follows: <br /> <br />Mayor Gamec state~ the major concern for the citizens is their keeping <br />animals. The Council will be reasonable in regard to livestock as long as <br />the nuisance ordinance is respected and the nuisance ordinance will still be <br />in effect regardless of changing in zoning to agricultural. <br /> <br />Councilman Cox stated we should delete that portion from the ordinance regarding <br />the conditional use permit. He doesn't think it appropriate that they need <br />it due to the state influx of urban density. He doesn't think the farmer should <br />be penalized. <br /> <br />Mayor Gamec suggested no condition use permit necessary at 40 acre parcel or <br />over. Mayor Gamec asked if citizen's had any questions. <br /> <br />Councilman Sorteberg stated any 40 acre parcel can be on the 8 year program. <br /> <br />Citizen Jerry Peltzer asked what is our ordinance status re anims~s and acreage. <br />He is considering the 8 year program. ~ <br /> <br />Mayor Gamec suggested he talk to City Administrator Schnelle and get on the <br />Planning and Zoning agenda for any zoning changes he wants to make. <br /> <br />Citizen Scroggins inquired about the effect on green acres? Mayor replied <br />there would be none. <br /> <br />Councilman Cox stated the ordinance should stay as is for under 20 acres. <br /> <br />Mayor Gamec stated 40 acres or less would protect more, <br /> <br />Motion by Councilman Cox and seconded by Councilman Sorteberg to direct the staff <br />to prepare an ordinance changing Sl10.90 amending it to eliminate the <br />requirement of a conditional use permit for animals on any tract of land which is <br />20 acres in size or larger. <br /> <br />Motion carried. Voting yes: Mayor Gamec, Councilman Sorteberg, Councilman <br />Reimann, Comncilman Cox and Councilwoman Van Wagner. Voting no: None. <br /> <br />City A~ninistrator Schnelle addressed the issue on structure .building require- <br />ments without a building permit. Attorney Goodrich suggested Building Official <br />Berg should check the State Building Code regarding farm building requirements. <br /> <br />Citizen~ked if we are zoned agricultural or as we are, can we go back into animals <br />if we want to?
