CASE #9 - INDUSTRIAL REVENUE BOND, REQUEST FOR; REGARDING CITY APPROVAL;

CASE OF MR. DENNIS SHARP:

Motion by Councilman Cox, seconded by Councilman Sorteberg to adopt
Resolution #81-114 giving tacit approval to an Industrial Revenue Bond
to Mr. Dennis Sharp. (Please refer to resolution file for Resolution
#81-1~.4). Motion Carried. Voting Yes: Mayor Gamec, Councilmembers Cox,
Van Wagner, Sorterberg and Reimann. Voting No: None.

CASE #10 -HEXON REGARDING THE BOX CAR ISSUE:

City Attorney Goodrich stated that Councils motion was that we take Hexon
to court for moving in a box car without City approval. The court's
decision was a $150 fine and 30 days in jail, the 30 days being suspended
if Mr. Hexon complies with the City Code for one year. The next step is
to inform the County if he is or is not in compliance with the City Code.
If he is not, the County will proceed to invoke the 30 day sentence.
City Administrator Schnelle stated that if the box car is going to be used
as a place of storage, it will have to be inspected by a building inspector.
If it is to be used as a place of business, it will have to be inspected
by a structural engineer. Does the Council want it inspected or removed.
At this time, Mr. Hexon presented copies of a letter to him from Graphic
Design Architects dated July 28, 1981, stating they could not take on the
project since matter was pending in court.

Building Tnspector Berg stated he had been out to the site but had not
performed an actual inspeciton.

Mr. Hexon stated the delay on his part was due to injuries sustained in
an accident.

Mayor Gamec informed Hexon that he has had plenty of opportunities to
comply with ~e ordinance, that the city has been more than lenient and
that he does not feel the structure will meet code requirements.

~. Hexon replied that the box car is now going to be used for storage.

Mayor Gamecs advice was to deny Hexon's request, because the City does
not want a lot of box cars sitting around without being dressed up.

Councilman Cox stated that if it was not going to be permitted, why did
we choose he come in with a Site '& Design Plan? Now we have a directive
from Court that he is to be in compliance with the City Code. If it
wasn't an offensive idea to the Council in the first place, why are we
now stating that it does not fit into the community?

Mayor Gamec replied that when Mr. Hexon fir§t brought in the box car,
it hadn't been inspected.

Councilman Cox replied that we have a letter from Berg stating he did
visit the site. If Council is going to be this harsh, we have other
offenses in the City of Ramsey, that are just as bad, that we have done
nothing about. We should be fair to residents as well as commercial.
We have a violation of ordinance -- the directive is then to comply.

C/August 25, 1981
Page8
