Mr. Kytonen said they have agreed to do that. Councilman Cox expressed concern about access onto Highway 47 from 149th Lane. He would rather see it access onto CSAH 5. Councilman P~e~_mann felt that at the least a possible future access should be provided onto CSAH 5. Mr. Kytonen said he feels he would have to have a variance on the lot size if 149th Lane was extended to CSAH 5 and that leaving the cul de sac there is a safety factor. Discussion held on where houses would be placed. Mr. Kytonen said he felt this should be ].eft to the builders discretion. Mayor Gamec said that it should show which three lots would be grouped together and that they should be designated in some way. Administrator Schnelle suggested referring to Flintwood Hills II to see how that plat was handled. Mr. Jack Menkveld said the lots in this area are marginal water table lots (referring to his property south of the proposed development) and they can't be developed until sewer and water is available. He has a maximum of two building sites on 19 acres until sewer comes through. He feels paving of 149th Lane is unrealistic at this time. Motion by Councilman Reimann and seconded by CoUncilman Mickelson to extend 149th Lane to provide an access onto CSAH 5 and that the developer escrow an amount for 1/2 of the cost of paving the road, the~'amount tO be determined by the City Engineer; subject also that a park dedication fee be paid in accordance with the City Ordinance and subject to Planning & Zoning recommendations: 1) Drainage and drainage easements along with ponding areas be resolved. 2) A performance bond/development contract be signed prior to lot grading to ensure adequate elevation. 3) Temporary turnaround at the end of Helium Street be provided. 4) Street names conform to existing City street names. 5) Variance to article 170.038H of the City Code requiring inspection and evaluation of lots by City Plumbing inspector. 6) Disposition of Outlot A be resolved. 7) Plan showing actual building sites be submitted. 8) Developer to provide soils tests 9) Curve at intersection of 149th Lane and 150th Curve be designed with 100 foot radius. 10) Restrictive convenants be included with plat if not in violation of City ordinances. And, subject to the City Engineers review and approval to ascertain conformance of the above requirements. Motion carried. Voting yes: Mayor Gamec, Councilmen Cox, Mickelson, Reimann and Sorteberg.
