During the term of this Ordinance, notwithstanding Chapter 9 of the City Code, entitled "Zoning <br />and Subdivision of Land", no subdivision or plating of any land within the City shall be <br />permitted and no applications for said subdivision or platting shall be accepted, except for those <br />lands identified in Sections 5 and 6 below. <br /> <br />SECTION 5. EXCLUSIONS <br /> <br />The following lands within the City are excluded from this Interim Ordinance: <br /> <br />1. All land currently located within the City's following listed zoning districts: <br /> <br />R- 1 Residential - MUSA District <br />R-1 Residential - Central Rural Reserve Area <br />R- 1 Residential - Rural Preserve <br />R-2 Medium Density Residential District <br />R-3 High Density Residential District <br />B-1 Business District <br />B-2 Business District <br />E-1 Employment District <br /> <br />E-2 Employment District <br />MU-PUD Mixed-Use, Planned Unit Development District <br />PUD Planned Unit Development District <br />TC Town Center District <br />P Public/Quasi Public District <br /> <br />SECTION 6. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship may result form strict compliance. In granting an exception, the City <br />Council shall prescribe any conditions that it deems necessary to or desirable for the protection of <br />the public interest. NO exception shall be granted unless the City Council finds: <br /> <br />That there are special circumstances or conditions affecting said property such <br />that the strict application of the provisions of this Interim Ordinance would <br />deprive the petitioner of the reasonable use of petitioner's land. <br /> <br />That the exception is necessary for the preservation and enjoyment of a substantial <br />property right of the petitioner. <br /> <br />That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property is situated. <br /> <br />That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and will not <br />adversely affect the planning process for adoption of amendments to the <br />Comprehensive Plan above described. <br /> <br />Ordinance #04-21 <br />Page 2 of 3 <br /> <br /> <br />
