Voting No: None. <br /> <br />Case #9: <br /> <br />Consider Request to Rezone Certain Property from R-1 Residential to B-2 <br />Business; Case of Patrick Fitzpatrick <br /> <br />Assistant Community Development Director Trudgeon explained as discussed in the previous <br />Comprehensive Plan Amendment case, the subject property's zoning was changed to residential <br />to comply with the 2001 Comprehensive Plan. The Findings of Fact relating to the request fi'om <br />Mr. Fitzpatrick have been drafted in the negative based on the recommendation of the Planning <br />Commission. <br /> <br />Motion by Councihnember Cook, seconded by Councilmember Elvig, to adopt Resolution #04- <br />05-138 adopting Findings of Fact #0676 relating to a request from Patrick Fitzpatrick to rezone <br />the subject property from R-1 Residential to B-2 Business. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Elvig, Kurak, Pearson, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Strommen, to deny the request to <br />rezone the subject property, based on the Findings of Fact. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #10: <br /> <br />Introduce Ordinance to Amend Shoreline Management Regulations of the <br />City Code <br /> <br />Assistant Community Development Director Trudgeon explained the Environmental Overlay <br />regulations of the City Code are the remaining sections of Chapter 9 in need of updating as a <br />result of the adoption of the new Comprehensive Plan. The proposed ordinance relates to <br />Shoreland Management. The Shoreland Overlay district is proposed to be amended with some <br />minor revisions from the 1990 State Shoreland Model Ordinance, the model that all lake and <br />river communities adopt in the same form. Shoreland Management regulates all lands adjacent to <br />state designated public waters, with the exception of the Mississippi and Rum Rivers in Ramsey <br />where Critical Area and Wild and Scenic regulations are in place. He reviewed the proposed <br />modifications to the State Shoreland management model ordinance covered in Section 9.24.05 <br />Subd. 6 and Section 9.24.05 Subd 5. He reported the Planning Commission held a public <br />hearing and received no comments, and the Commission recommended that the proposed <br />revisions to the Shoreland Management regulations be adopted. <br /> <br />City Council/May 25, 2004 <br />Page 18 of 27 <br /> <br /> <br />
