Counci hnember Kurak questioned if big box is allowed in TC-2. <br /> <br />Assistant Community Development Director Trudgeon replied anything over 35,000 square feet <br />is allowed as a conditional use permit, and there is no cap on how big that could be. <br /> <br />Counci hnember Kurak questioned if"discourage" is strong enough. <br /> <br />City Administrator Norman replied there are examples around the country where zoning <br />language changes do not work. Developments such as Wal-mart have found ways around that <br />process. The intent is to direct staff to work with the developer, as they have a lot of tools they <br />Call tlse. <br /> <br />Councihnember Cook questioned if the term "prohibit" could be used. <br /> <br />City Attorney Goodrich advised the City cannot stop competition and there is a concern with the <br />legal aspects of that. <br /> <br />Councihnember Kurak questioned the rationale regarding the zoning. <br /> <br />Assistant Colnmunity Development Director <br />companies could go around the restrictions, <br />grocery and one for retail. <br /> <br />Trudgeon replied there may be other ways the <br />such as building two separate buildings, one for <br /> <br />C o u nc il m em bet Kurak questioned how the term "discourage" would work with that scenario. <br /> <br />City Administrator Norman replied all the land is not for sale yet. The developer would need to <br />work with the City, and if staff is given direction by the Council the developer would be <br />informed of what would not be allowed in the project. <br /> <br />Councilmen~ber Strommen asked if the concern extends beyond big box grocery. <br /> <br />City Administrator Norman replied it was always imagined there would be large box in Town <br />Center. The concern is the grocery, which is the main anchor of the Town Center project. <br /> <br />Councihncmber Strommen noted page 344 in several of the action steps "see and secure <br />fimding" should be corrected to "seek and secure funding". She noted page 345 states "The City <br />will identify and implement corridor improvements in the segment north of Alpine Drive." She <br />suggested this be amended to reflect partnership with the city of Anoka and Anoka County. <br /> <br />Councihnember Kurak asked if this language will alleviate the concern of disclosure regarding <br />what may happen with the interchange. <br /> <br />City Attorney Goodrich replied this could serve as the City's official action regarding this <br />subject. <br /> <br />City Council/May 25, 2004 <br />Page 25 of 27 <br /> <br /> <br />
