-2-
Special Meeting/C
December 6, 1977

also explained that the rough-in as placed in Room #9 was
done in that manner as a part of cost cutbacks prior to bid
letting. With regard to the use of exposed ducts through-
out the building Mr. Boarman indicated that the archi-
tectural design is generally accepted in the industry and
has won several awards for outstanding design. Mr. Boarman
also indicated that the most important thing to him, however,
was that the owner was not happy.

Mr. Jack Wilberding of Setter, Leach and Lindstrom reempha-
sized what Mr. Boarman had indicated and also suggested that
in his opinion it would be a mistake to enclose the duct
work at this point, feeling it would hurt the overall build-
ing design. He also stated that he did not feel there was
any financial responsibility on the part of Setter, Leach
and Lindstrom to correct the exposed duct. He felt that
the exposed duct was clearly indicated in the communications
and contract documents prior to bid letting.~

Dave Mickelson agreed that while he was on the Building
Advisory Committee the exposed duct had been discussed but
did not feel that the extent of use was clearly indicated.

Mr. Wilberding also indicated that there were cost consider-
ations as well as design considerations that went into the
proposal of exposed duct.

Addressing some of the other issues, Mr. Boarman indicated
that Setter, Leach and Lindstrom does regret the oversight
on the part of the mechanical plans to provide a lift pump
for the drainfield. He indicated that Setter, Leach and
Lindstrom has a responsibility for the mechanical engineers;
but that they do not have complete control because they are
contracted and not the engineers of Setter, Leach and Lind-
strom. Mr. Boarman indicated that Setter, Leach and Lind-
strom does take responsibility for the error of the lift
station for the drainfield which was discussed at an earlier
council meeting. It was his feeling that the mistake comes
about as a part of the work pressures related to this pro-
ject for 90 day on-site labor after grant offer. He indi-
cated that Setter, Leach and Lindstrom has negotiated a
settlement with Nelson-Rudie, the mechanical engineer, for
the approximately $1,600 change order to install the lift
pumps.

Mayor Cox indicated that after the discussions of this meet-
ing he is resigned to the fact that the exposed duct will
have to be kept in place, however, he feels it important
Setter~ Leach and Lindstrom be aware that the client is not
