Regular Council Page 6 November 13, 1978 In regards to a building permit application on the proposed plat of High Point entailing the entire 40 acres it is the Council's concensus to not grant the building permit. Motion by Councilman Mickelson and seconded by Councilman Reimann to not issue a building permit to Mr. Tom Holker on the proposed plat of High Point as it does not comply with the City's road ordinance. However, one can be issued for this at such time it does meet all the City ordinances on bonding, etc. and the City will accept a letter of credit. Motion carried. Voting yes Councilman Gamec, Councilman Mickelson, Council- man Reimann, Councilman Muller and Mayor Cox. Voting no None. REZONING REQUEST OF FRED ARMSTRONG. Motion by Councilman Reimann and seconded by Councilman Mickelson to adopt the following finding of fact on the rezoning request of Fred Armstrong: 1. That applicant has applied to have the City's Zoning Ordinance amended so as to cause his property legally described as: The North half of the Northeast Quarter of Section 17, Township 32, Range 25, Anoka County, Minnesota. The South half of the Northeast Quarter of Section 17, Township 32, Range 25, Anoka County, Minnesota EXCEPT that part thereof described as follows: Commencing at a point on the East line of the South Half of the South- west Quarter of said Northeast Quarter which is 150 feet south of the Northeast corner thereof; Thence South along said East line to the South line of said South Half of Southwest Quarter of Northeast Quarter; thence West along said South line of the West line of said South Half of Southwest Quarter of Northeast Quarter; thence North along said West line of the North line of said South Half of Southwest Quarter of Northeast Quarter; thence East along the said North line to a point that is 300 feet West of the Northeast corner of said South Half of Southwest Quarter of Northeast Quarter; thence South- easterly in a straight line to the point of commencement. and West 30 acres of the Southwest Quarter of the Southeast Quarter of section 8, Township 32, Range 25, Anoka County, Minnesota, EXCEPT that part thereof lying Southwesterly of Armstrong Blvd. N.W. as now laid out. qhat part of the Southwest Quarter of the Southeast Quarter of Section 8, Township 32, Range 25, Anoka County, Minnesota, that lies South- westerly of Armstrong Blvd. N.W. as now laid out. 'Fhe Southeast Quarter of the Southwest Quarter of Section 8, Township 32, Range 25, Anoka County, Minnesota. to be located in that development area known as the Transition Area instead of the Rural Service Area.
