Regular Council <br />Page 3 <br />November 27, 1978 <br /> <br />Councilman Reimann feels that in the best interest of the people of this <br />City of Ramsey and others who come to our City, to not approve the sub- <br />division request as it would be a traffic hazard on County Road #57 and <br />they cannot provide a safe entrance. <br /> <br />Mr. Jim Nielsen, Tom Holkers attorney expounded on past times at Council <br />meetings and feels the real question here is the building permit for a <br />moved in house. <br /> <br />A general discussion followed in regards to the subdivision request. <br /> <br />Motion by Councilman Reimann and seconded by Councilman Gamec to instruct <br />the staff to prepare findings-of-fact in the denial of the subdivision re~. <br />quest of Mr. Tom Holker, said findings to be presented to the Council on <br />December 11, 1978 for its formal action. <br /> <br />Mr. Nielson read MSA 462.538 subdivision 4 and stated he felt the Council <br />was arbitrary and capricious in their decision. <br /> <br />Motion carried. Voting yes Councilman Gamec, Councilman Reimann, Council- <br />man Muller and Mayor Cox. Voting no Councilman Mickelson. <br /> <br />Councilman Mickelson stated he wants the Attorney Generals opinion before <br />he makes a decision. <br /> <br />BUILDING PERMIT FOR MOVED IN HOUSE <br /> <br />A general discussion on Mr. Holker's request for building permit for a <br />moved in house on the corner of County Road #57 and C.S.A.H~ #5 followed~ <br /> <br />Motion by Councilman Reimann to deny the request for a building permit for <br />the moved in house on Parcel B of Mr. Holker's proposed metes and bounds <br />subdivision on County Road #57 and C.S,A.H. #S. <br /> <br />Councilman Muller asked if Mr. Holker would consider combining two parcels. <br />Mr. Nielson stated they would not. <br /> <br />It was the general concensus of the Council that they have already addressed <br />the request at earlier meetings and there is no need for a motion since the <br />subdivision has not been granted and, therefore, only one parcel of record <br />exists at this time which already has a home on it. <br /> <br />Councilman Reimannwithdrew his motion stating that everYone agrees this <br />has been addressed. <br /> <br />It was stated this moved in house is a nuisance and if someone were to get <br />hurt that both parties would be liable. Councilman Reimann feels the City <br />would not be liable. <br /> <br />Motion by Councilman Reimann and seconded by Councilman Mickelson to give <br />Mr. Tom Holker until December 15, 1978 to have this building removed from <br />Parcel B of Mr. Holker's proposed metes and bounds subdivision. <br /> <br />Motion carried. Voting yes Councilman Gamec, Councilman Mickelson, Council- <br />man Reimann, Councilman Muller and Mayor Cox. Voting no None. <br /> <br /> <br />
