Regular Council Page 3 November 27, 1978 Councilman Reimann feels that in the best interest of the people of this City of Ramsey and others who come to our City, to not approve the sub- division request as it would be a traffic hazard on County Road #57 and they cannot provide a safe entrance. Mr. Jim Nielsen, Tom Holkers attorney expounded on past times at Council meetings and feels the real question here is the building permit for a moved in house. A general discussion followed in regards to the subdivision request. Motion by Councilman Reimann and seconded by Councilman Gamec to instruct the staff to prepare findings-of-fact in the denial of the subdivision re~. quest of Mr. Tom Holker, said findings to be presented to the Council on December 11, 1978 for its formal action. Mr. Nielson read MSA 462.538 subdivision 4 and stated he felt the Council was arbitrary and capricious in their decision. Motion carried. Voting yes Councilman Gamec, Councilman Reimann, Council- man Muller and Mayor Cox. Voting no Councilman Mickelson. Councilman Mickelson stated he wants the Attorney Generals opinion before he makes a decision. BUILDING PERMIT FOR MOVED IN HOUSE A general discussion on Mr. Holker's request for building permit for a moved in house on the corner of County Road #57 and C.S.A.H~ #5 followed~ Motion by Councilman Reimann to deny the request for a building permit for the moved in house on Parcel B of Mr. Holker's proposed metes and bounds subdivision on County Road #57 and C.S,A.H. #S. Councilman Muller asked if Mr. Holker would consider combining two parcels. Mr. Nielson stated they would not. It was the general concensus of the Council that they have already addressed the request at earlier meetings and there is no need for a motion since the subdivision has not been granted and, therefore, only one parcel of record exists at this time which already has a home on it. Councilman Reimannwithdrew his motion stating that everYone agrees this has been addressed. It was stated this moved in house is a nuisance and if someone were to get hurt that both parties would be liable. Councilman Reimann feels the City would not be liable. Motion by Councilman Reimann and seconded by Councilman Mickelson to give Mr. Tom Holker until December 15, 1978 to have this building removed from Parcel B of Mr. Holker's proposed metes and bounds subdivision. Motion carried. Voting yes Councilman Gamec, Councilman Mickelson, Council- man Reimann, Councilman Muller and Mayor Cox. Voting no None.
