Regular Council <br />Page 2 <br />December 11, 1978 <br /> <br />LETTERS AND COMMUNICATIONS <br /> <br />Mayor Cox read a letter from Mr. John Boland on the Solid and Hazardous <br />Waste Management Policy Plan. It was the general concensus of the Council <br />to turn this over to City Engineer Sha for his review. <br /> <br />COUNCIL OLD BUSINESS <br /> <br />FIN])INGS OF FACT REGARDING THE DISAPPROVAL OF SUBDIVISION OF 1AND BY METES <br /> <br />AND BOUNDS; CASE OF TOM HOLKER <br /> <br />Motion by Councilman Reimann and seconded by Councilman Gamec to disapprove <br />the request of Tom Holker for subdivision by metes and bounds based on the <br />following findings of fact: <br /> <br />FINDINGS OF FACT AND MOTION RE Tom Holker subdivision request on property <br />located in the NWquarter of NWquarter of Section 23, Township 32, Range 25. <br /> <br />1) That at a special Council meeting held on November 2, 1978, applicant <br />appeared with his attorney concerning a home he had moved into the City at <br />the corner of County Roads #5 and #57. At said meeting applicant presented <br />a proposed metes and bounds subdivision survey to the Council,. which survey <br />was drawn by Keith Graham, dated August 14, 1978, and was revised <br />September 19, 1978. This was the first opportunity the Council had had to <br />review the proposed subdivision. <br /> <br />2) That the Council following its subdivision procedures, referred the sub- <br />division to the Planning and Zoning Commission for its review. <br /> <br />3) That on November 6, 1978, applicant and his attorney appeared before <br />the Planning and Zoning Commission requesting the subdivision. The Council <br />has reviewed the Planning and Zoning's minutes and recommendation of <br />November 6, 1978, and said minutes are hereby incorporated by reference. <br /> <br />4) That the City waived the required public hearing on the'applicants' sub- <br />division request because a public hearing had been held on the subject prop- <br />erty when it was originally a part of the proposed High Point Plat. <br /> <br />S) That the applicant and his attorney appeared at the Council's November 13, <br />1978, and November 27, 1978, meetings concerning the subdivision request, the <br />November 1S, 1978, and November 27, 1978, meeting minutes are hereby incor- <br />porated by reference. <br /> <br />6) That to grant the subdivision as requested will create two additional <br />accesses onto Sunfish Lake Blvd. or County Road #5. <br /> <br />7) Subdivision as presented by applicant does not provide for concentration <br />of access to C.S.A.H. #57 and County Road #5 onto these busy arterial high- <br />ways. <br /> <br />8) That numerous uncontrolled accesses onto all County arterial highways is <br />detrimental to the safety and welfare of the residents of the City. <br /> <br /> <br />
