Motion carried. Voting Yes: Mayor Strommen, Councilmembers LeTourneau, Johns, Kuzma, <br />Riley, Shryock, and Williams. Voting No: None. <br />7.02: Consider Adopting Resolution #16-02-042 Approving Request Related to Harvest <br />Estates Housing development; Case of G S Land LLC <br />Community Development Director Gladhill reviewed the staff report and recommendation to <br />approve the request related to Harvest Estates Housing Development for an extension based on <br />the recommended term sheet, which includes the establishment of a new real estate escrow. <br />Councilmember Kuzma asked the provision that would be included if they missed the deadline <br />and an extension is now given. <br />Community Development Director Gladhill responded that the City could then call on the letter <br />of credit, which was required as part of the surety, noting that the applicant is in agreement in <br />with that clause. <br />Councilmember Williams agreed that additional consideration should be given from the <br />developer, the additional escrow, as it is not in the interest of the City to hold this land. <br />Councilmember Riley stated that he would like to see the contract followed on each side, but <br />noted if that is not going to work there can be negotiation but agreed that additional <br />consideration should be given from the developer. <br />Mayor Strommen agreed that in past situations of this nature that have occurred, that element has <br />been applied and should continue to be applied in this negotiation. <br />Asst. City Administrator/Economic Development Manager Brama stated that this would also <br />provide time for the developer to see how the market absorbs their properties as this would <br />provide the latitude to apply for an extension. <br />Mayor Strommen confirmed the position of the developer that he is in agreement with this as <br />proposed and does not see it as unreasonable. <br />Motion by Councilmember Williams, seconded by Councilmember Riley, to Adopt Resolution <br />#16-02-042 Granting Extension to Purchase Agreement and Denying Extension of Development <br />Agreement for Harvest Estates. <br />Further discussion: Councilmember Shryock asked and received confirmation that the motion <br />included an establishment of the $15,000 escrow. <br />Motion carried. Voting Yes: Mayor Strommen, Councilmembers Williams, Riley, Johns, <br />Kuzma, LeTourneau, and Shryock. Voting No: None. <br />City Council / February 23, 2016 <br />Page 5 of 9 <br />
