A higher level of <br />animal control will cost more money; if that is the desire, it should be <br />brought to Council's attention while they are in the budget process. <br /> <br />Chairman Zimmerman stated that the Commission would like more time to <br />review the draft ordinance before passing a recommendation onto Council. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner LaDue to <br />table any action on the proposed ordinance dealing with vicious animals <br />until the next regular Planning and Zoning Commission meeting. <br /> <br />Further Discussion: Commissioner Hendriksen stated that he feels the <br />proposed ordinance puts an arbitrary person in the position of making a <br />decision and the owner is guilty until proven innocent. Commissioner Holm <br />noted that the ordinance lists 4 conditions that must exist before <br />destruction of an animal can be ordered. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioner Shumway, <br />LaDue, Holm, Terry and Hendriksen. Voting No: None. Absent: <br />Commissioner Howell. <br /> <br />Case #7: Request For Site Plan Review; Case Of Mr. William Dubats: <br /> <br />Ms. Norris recalled that on November 3, the Commission recommended approval <br />of Mr. Dubats' request for a conditional use permit to construct and <br />operate a self-service storage facility at 13820 Ebony Street. The <br />Commission tabled action on the site plan pending additional information <br />from city staff. Ms. Norris provided the Commission with a memo from <br />herself to the Commission dated November 9, 1987 summarizing issue <br />resolutions discussed by staff and Mr. Dubats. <br /> <br />Ms. Norris stated that Mr. Dubats' proposal involves 80% of the site being <br />impervious surface; John Stine of DNR has no problems with that if the City <br />Engineer feels there is adequate drainage; the City Engineer has indicated <br />that the storm sewer system is adequately sized for now but not for when <br />the area is totally developed. <br /> <br />Mr. Dubats stated that he is willing to deed to the city the extra 7' of <br />right-of-way needed for future improvements of 138th; to do so without <br />changing proposed building locations will require a variance to rear yard <br />setback; that variance would also be necessary in order to place the new <br />buildings in such a way that the two facilities appear to be one business <br />even though they are two separate lots of record. <br /> <br />Chairman Zimmerman inquired if Mr. Bubats' is willing to have access from <br />Ebony Street as the city is attempting to limit access on the future Front <br />Street (138th Avenue). <br /> <br />Mr. Dubats stated that per his discussion with staff on November 5, it was <br />his understanding that access would be allowed from 138th provided the <br />access gates were recessed. <br /> <br />Ms. Norris noted that fencing will be the industrial standard, chain link <br /> <br />Page 3 of 6 <br /> <br /> <br />
