topped with barbed wired, which is also the most condusive to police
viewing of property. Mr. Dubats will also be providing a 20 foot wide
landscaped area in the front yard to improve property appearance. The
buildings will be constructed with decorative face block with steel roll up
doors.

Mr. Dubats stated that he understands that according to staff's
interpretation of code, doors are exclusive of that part of code stating
that 'no more than 50% of an exterior wall surface shall be steel' and that
a reinforced slab meeting frost footing requirements is to be resolved with
the City Engineer and City Building Official.

Ms. Norris noted that Item #10 of the proposed development permit should be
revised to indicate Mr. Dubats will provide the city with an additional 7
feet of right-of-way along 138th Avenue N.W.

Mr. Goodrich stated that Mr. Dubats has indicated that the holder of his
mortgage will not allow combining the two lots to eliminate the need for
setback variances because of legal implications.

Commissioner Hendriksen suggested that there also be an easement that could
access the buildings to the rear of the property in the event the two
parcels come under separate ownership in the future.

Commission consensus is that if the lots cannot be combined, a variance to
setback could be granted by the Board of A~justment based on the hardship
created by the requirement to deed an extra 7 feet of right-of-way along
138th to the city.

Motion by Commissioner LaDue and seconded by Commissioner Hendriksen to
recommend approval of Mr. Dubats' site plan and that Item #10 of the
development permit be revised to indicate that Mr. Dubats will provide the
city with an additional 7 feet of right-of-way along I38th Avenue N.W. and
that he will also provide a 15 foot access easement along the north
property line of his adjoining parcel in favor of this parcel.

Motion carried. He also stated that the proposed uses would serve as a good buffer
to the adjacent residential development.
