Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Holm and
Howell. Voting No: None. Abstain: Commissioner Hendriksen. Absent:
Commissioners LaDue and Shumway.

Case #5: Request For Sketch Plan Review; Case Of Mr. Les Millgr:

Les and Jack Miller were present. Jack Miller reviewed the sketch plan for
70 lots with the Commission and noted that final layout depends on the
alignment of sewer and water.

Chairman Zimmerman stated that he would like to see Waco Street extended
into this proposed subdivision.

Jack Miller noted that the sketch plan shows streets connecting into the
Rum Acres Estates and 153rd; they could also access onto Waco Street as
they presently own and control that street stub. A holding pond and an
outlet to the Rum River are planned for storm drainage. The average lot
size is 80'x135'; utilities will probably be extended privately in order to
develop this parcel.

Commissioner Howell stated that he would like to see the sketch plan
redrawn to show Waco Street connecting in.

Chairman Zimmerman requested that the Miller's redraw the sketch plan for
the Planning and Zoning review and in the meantime, work with City Council
regarding extending utilities to that property.

~se #1: Reque~ For Co~d%tional Use Permit To Extract Aggregates In
The I-1 I~gustrial District; Case Of Barton Sand And Gravel:

Gary Sauer and Don Obernolte were present at the meeting. Mr. Sauer stated
they are planning to develop their property into four 10 acre lots with a
road for a future industrial subdivision, screening and berming for the
residents to the north and protection of wetlands to the east. Mr. Sauer
stated he is requesting a conditional use permit to excavate the western
portion of the site. He stated that it would have a 5-7 foot berm of
dense, fast-growing trees to screen residents from the operation. Mr.
Sauer stated that he thinks he has an alternative site for the asphalt
plant; he is planning to move 300,000 yards of material from the site in
the next 3-5 years. Mr. Sauer feels there is enough flexibility in the
excavation plans to work with the City regarding the airport concerns. He
stated because of objections raised by residents, they have searched for
another site for the asphalt plant in a heavier industrial area.

Mr. Sauer stated that he would like a recommendation for approval of this
excavation. Eleven to twelve trucks per day will be hauling excavated
materials.

The Commission proceeded to review the findings of fact.

Mr. Obernolte stated that average elevation on the site would be 880 feet;
lowest elevation would be 875 feet; the ponding elevation is approximately
873 feet; and the existing wetland ordinary high water mark is
Planning & Zoning Commission/August 11, 1987
