3. There shall be no salvage or junk yard activities conducted from <br /> the business or in conjunction with the business. <br /> <br />4. There shall be no more than 70 vehicles for sale at any one time <br /> on the site. <br /> <br />5. The Applicant shall obtain any local and State licenses required <br /> before selling any vehicles from the property. <br /> <br />6. Ail signs erected on the premises shall be in accordance with <br /> Section 170.05 of the City Code. <br /> <br />7. There shall be no parking of any vehicles on any highway right-of- <br /> way · <br /> <br />Displaying of vehicles within the 50 foot setback will be on a <br />blacktop or concrete surface with the surfacing to be completed by <br />June 1, 1988. <br /> <br />9. The remaining display area shall be surfaced with blacktop or <br /> concrete by January 1, 1989. <br /> <br />Motion carried. Absent: Commissioners Hendriksen and <br />Howel 1. <br /> <br />Case #3: Request For A Conditional Use Permit-To'Keep~A-HorsePOn'L'ess <br /> Than Three Acres: Case Of Mr.'RobertMashuga: <br /> <br />Mr. and Mrs. Mashuga were present. <br /> <br />Chairman Zimmerman noted that the building housing the horse is 12 feet <br />from the property line; code requires a minimum of 75 feet. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner LaDue to table <br />any action on Mr. Mashuga's request for a conditional use permit until Mr. <br />Mashuga provides a site plan indicating that placement of the building <br />housing the horse is not causing an inconvenience to the neighbors. <br /> <br />Further Discussion: Mr. David Fall stated that the Mashuga property is <br />adjacent to a drainage area that tends to rise and encroach neighboring <br />properties; the pond is already a pollution problem and debris from the <br />horse entering that drainage area increases the problem. Mr. Luoma noted <br />that ordinance requires 3 acres to keep a horse; Mashuga's property is only <br />one acre. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Holm <br />and Shumway. Voting No: None.
