Chairman Peterson suggested that the Chief of Police obtain information <br />regarding the length of Mr. Rehbein's trucks and measure out the distance <br />between Hwy. ~10 and the Cty. Rd. #83 railroad crossing gates to determine <br />if there is sufficient clearanoe. It was also suggested that the potential <br />safety hazard be reviewed by Anoka County, Burlington Northern Railroad and <br />MN DoT. Chairman Peterson noted that there is also concern with the fact <br />that Cty. Rd. #83 does not have paved shoulders and there is a lot of bike <br />traffic to and from Brooks Market. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Deemer to <br />recommend approval of L&G Rehbein's request for a conditional use permit to <br />grade and excavate to create a man-made lake in Northfork contingent upon <br />the folloging: <br /> <br />1. Determination by Cit"t Attorney as to the persons liable in the <br /> event the water table of Lake Itasca is logered. <br /> <br />Determination that there is sufficient clearance bet~;een the Cty. <br />Rd. #83 railroad crossing and Hwy. #10 to accommodate a tractor- <br />trailer. <br /> <br />e <br /> <br />Obtaining the proper language and standards from DNR to require <br />provisions for monitoring water levels in both bodies of water to <br />be included as Item #12 in the conditional use permit. <br /> <br />4. References to 'shoreline' in Items 1 and 5 of the permit should be <br /> changed to ' shoreland'. <br /> <br />Se <br /> <br />Add Item #13 to the conditional use permit supporting that the <br />distance between the railroad crossing and Hwy. #10 will safely <br />accommodate a tractor-trailer. <br /> <br />6. ~ne required bond amount to be at City Council's discretion. <br /> <br />7. Determination of whether or not a natural resource tax should be <br /> charged on the fill material removed. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman, <br />Deemer, Shumway, LaDue and Howell. Voting No: None. Absent: <br />Commissioner Hendriksen. <br /> <br />Mr. Rehbein inquired if Pamsey charges a natural resource tax on the other <br />existing excavation permits. <br /> <br />Commissioner Deemer replied that two of the permit holders are not hauling <br />fill material out in any great quantity and the third permit holder is a <br />smaller operation with all fill going to the County. <br /> <br />The Commission recessed at 10:05 p.m. <br /> <br />Chairman Peterson called the meeting back to order at 10:17 p.m. <br /> <br />Case ~6: Request For Sketch Plan Review: Case Of Mr..
