Voting Yes: Chairman Peterson, Commissioners Zimmerman, <br />Shumway, Deemer, Howell and LaDue. Voting No: None. Absent: <br />Commissioner Hendriksen. <br /> <br />Ms. Norris noted that if the development plan is not approved, then the <br />rezoning to P.U.D. is void. <br /> <br />Mr. Raudio stated that Council requested that someone more familiar with <br />land use assist in the site plan and covenants; that is being done. <br /> <br />Chairman Peterson noted that City Attorney Goodrich is reviewing the <br />covenants with respect to it's legallity and gramatical composition; he <br />does not have the expertise to review it's content with respect to <br />addressing concerns of the developer and the City. <br /> <br />Ms. Norris noted that the City Engineer would like to see a drainage, <br />grading and access plan. <br /> <br />Motion by Commissioner Howell and seconded by Commissioner Deemer to table <br />approval of the preliminary development plan review for Mr. Gilbert <br />Menkveld's proposed P.U.D. until concerns of the City Engineer and City <br />Attorney have been addressed. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Zimmerman, <br />Shumway, Deemer, Howell and LaDue. Voting No: None. Absent: <br />Commissioner Hendriksen. <br /> <br />P~quest For A Conditional Use Permit To Grade And Excavat~ <br /> ~Q Create A Man-Made Lake In Northfork: Case Of L&G Rehbein. <br /> Inc. And North Fork. Inc.: <br /> <br />Chairman Peterson noted that this case had been previously tabled to allow <br />time to obtain information frc~ DNR and the City Engineer regarding the <br />potential impact to Lake Itasca and an alterantive traffic pattern for <br />truck traffic when Cty. Rd. ~83 is under construction improvements. <br />Chairman Peterson stated that DNR says that excavation to a depth of 30 <br />feet should have no impact on water levels in Lake Itasca, however they <br />recommend monitoring water levels in both bodies of water. NO DNR permits <br />are required for excavation unless dewatering for excavation occurs in <br />excess of 10,000 gallons/day or 1 million gallons/year. <br /> <br />The Commission reviewed City Engineer Raatikka's letter dated April 8, <br />1987. <br /> <br />Commissioner Deemer expressed a great deal of concern with the consistent <br />truck traffic that will be created on Cty. Rd. #83 and the potential safety <br />hazard at the railroad crossing. Commissioner Deemer stated that he <br />doesn't feel a truck-trailer stop at the intersection of Hwy. 910 and Cty. <br />Rd. #83 and safely clear the railroad crossing gates. <br /> <br />Mr. Rehbein stated that his trucks have never had any trouble before at <br />railroad crossings. <br /> Planning & Zoning/Aril 7, 1987 <br /> <br />Page 7 of 10 <br /> <br /> <br />
