out of the area immediately.

Mr. Wrench - Inquired as to the policy regarding hauling on windy days.

Chairman Peterson - Replied that hauling on windy days would be addressed
in the conditional use permit.

Mr. Shapell - Stated that he didn't believe that residents in Elk River,
Sherburne County, were notified and that they would probably have concerns
because they would also have to look at the excavation.

Chairman Peterson commented that the City of Elk River had been notified of
the proposed project.

Sandy Shapell - 9325 164th Lane - Inquired whether fencing would be
required around the excavated areas to prevent access by children and 3-
wheelers.

Mr. Peck replied that Northfork would obviously have a liability for the
creation of the lake; fencing may not be reasonable, but berming may be
possible. The area would definitely be posted with signs. Mr. Peck also
commented that the City would require slopes not to exceed certain limits.

David Pavelik - 8551 156th Lane - Inquired as to the long term effect of
the lake and if it would impact Lake Itasca.

Mr. Rehbein - Replied that the manmade lake would be separate from Lake
Itasca.

Mr. Peck - Commented that there is an overall storm water drainage plan
that the City is in the process of adopting. If the manmade lake reaches a
certain level, the overflow will drain into Lake Itasca; Lake Itasca
overflow will drain south towards Hwy. 10.

David Pavelik - Inquired if iow lying areas to the east would be developed.

Mr. Peck - Replied that 35 acres has been deeded to the City as park land;
no other development is proposed on the east side of Lake Itasca.

ADJOURNMENT

Motion by Commissioner Deemer and seconded by Commissioner Howell to
adjourn the public hearing.

Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer,
Shu~way, Zimmerman, Howell, Hendriksen and LaDue.
