1987. <br /> <br />~OMMISSION ~3$INESS <br /> <br />~ R_~uest For Conditiopa] Use Permit To Grade And Excavate To <br /> ~reat~ .A Manmade Lake In The Northfork P.U.D.; Case Of L&G <br /> ~ehbein, Inc.: <br /> <br />Chairman Peterson noted that DNR has requested that the City table any <br />action on this request in order that they may have n~re time to review the <br />impacts of the manmade lake on Lake Itasca. The Commission should proceed <br />to review the case so that the developers will know any other areas that <br />need additional attention. <br /> <br />The Commission proceeded to review the proposed findings of fact. <br /> <br />Commissioner Zimmerman inquired if any deep soil borings have been <br />performed in the proposed location for the lake and if a liner is being <br />considered for the lake. Commissioner Zi~nerman noted an instance where <br />the County excavated beyond the clay liner into gravel; all the water from <br />the lake drained out and the result was a swamp. What are the consequences <br />if this excavation goes into granular soils? <br /> <br />Mr. Rehbein - Stated that if clay is encountered during excavation, <br />excavation will cease. The project is engineered so that the water table <br />of the manmade lake will stay constant with Lake Itasca. The only way the <br />water can be lost is if <br /> <br />Mr. Rehbein replied that the projectwill be excavating through granular <br />materials all the way; the problemarises when you pass through clay and <br />proceed into granular material again; if this excavation hits clay, <br />excavation will stop. <br /> <br />Commissioners Zim~erman and Deemer requested that deeper soil borings be <br />performed to prove that the excavation process will not lower the water <br />table in the area. <br /> <br />Mr. Peck stated that the City Engineer was supplied with all the data he <br />felt would be necessary; request that the Commission be specific about <br />additional information requested and who will be reviewing it. <br /> <br />Commissioner Deemer replied that what is required is in the mining <br />ordinance, which is the same as the State's. <br /> <br />Ms. Norris stated that the City Engineer interpreted this project as <br />grading and excavating needing a conditional use permit. <br /> <br />Commissioner Deemer statedthat removal of more than 200 yards of earth <br />from a site requires a mining permit. A conditional use permit is needed <br />for mining. <br /> <br />Mr. Rehbein requested approval to excavate as far as the water table this <br />summer in order to at least provide for a drainage pond. <br /> <br />P & Z/March 3, 1987 <br /> <br />Page 3 of 9 <br /> <br /> <br />
