Mr. Peck inquired if maybe the excavation for drainage purposes and
excavation for creation of lake should be addressed as two separte items
in order to provide for drainage needs as soon as possible.

Chairman Peterson replied that if the City Engineer feels requirements for
a drainage area are met, the developers can proceed with the necessary
excavation and continue to pursue the conditional use permit for additional
excavation required for the lake creation.

Chairman Peterson and Commissioners Deemer and Zimmerman stated that they
have no problem with the creation of the lake after environmental questions
are answered.

Commissioners Hendriksen and Shut, ay stated that they do not recall that
the P.U.D. was to include a manmade lake; there was discussion of Lake
Itasca being a private lake; request that this proposal be referred back to
Parks and Recreation Commission for their review. Commissioner Hendriksen
stated that he is not in favor of the creation of a manmade lake and in his
opinion, the excavation for drainage and lake creation should be pursued as
one permit. Commissioner Hendriksen stated a $7500 bond is inadequate for
a project of this magnitude.

Mr. Rehbein noted that the $7500 is to cover anything beyond the 5 acres
that the developer might have open at any one time, which would be in
violation of the permit.

Chairman Peterson suggested that the required bond amount be reviewed again
by City Engineer Raatikka.

Commissioner Deemer expressed concern for the additional wear and tear to
MSA route 153rd by the heavy truck traffic.

Chairman Peterson suggested that the City Engineer also review the impact
of expediting normal wear and tear to 153rd by heavy truck traffic.

Commissioner Zi~merman requested confirmation from the City Engineer that
the excavation process will not lower the water table in the area and the
liability incurred by the City if that should happen.

Commissioner Hendriksen stated that there should be a limit placed on the
amount of material that can be stockpiled at any one time.

Chairman Peterson requested an opinion from City Attorney Goodrich
regarding concerns for safety factors expressed by citizens and any
liability incurred by the City.

Motion by Commissioner Deemer and seconded by Commissioner Zimmerman to
table L&G Rehbein's request for a conditional use permit to excavate and
create a manmade lake in the Northfork P.U.D. until all information
requested has been submitted to and reviewed by City Staff.

Motion carried. Voting Yes: Chairman Peterson, Commissioners Deemer,
Shumway, Zimmerman, Hendriksen, ~Due and Howell. Voting No: None.

P & Z/March 3, 1987
