rI W]IEREAS, by a resolution of the Anoka City Con,nission dated April 14, 1967 a "Statements of Policy and intent by the City of Anoka regarding the proposed operation of a sanitary lal~dfill in Ra~]sey Township" was adopted by Anoka, and WHER]~AS, item number 5 of the resolution referred to above states I i I "The entire tract of land will ultimately be aimed at public use development, i.e., recreation, parks, etc., which will enhance the value of the abutting and surrounding properties" and Eq{EREAS, Anoka does not desire to establish, develop or maintain any public use areas within Ramsey; I I I I I I I I I I NOW, TItEREFORE, it is hereby agreed by and between the parties hereto: 1. Anoka will convey fee title by Deed to the landfill site to Ramsey no sooner than October 31, 1981, and no later than December 1, 1981. The legal description of the property to be conveyed is' legally described as follows: -- Parcel 1. The South one half ( S 1/2) of the Southeast one quarter (SE 1/4) of Section 22, To%rnship 32, Range 25, in the Township of Ramsey, County of Anoka, State of Minnesota. Parcel 2 The North one half (N 1/2) of the Northeast one quarter (NE 1/4) of Section 27, Township 32, Range 25, in the Township of Ramsey, County of Anoka, State of Minnesota. 2. In consideration of the aforedescribed conveyance Ramsey covenants and agrees that the property so conveyed shall be used for public recreation porpose~'unless and until the parties hereto shall agree otherwise, and as f, rther consideration Ramsey shall be responsible for any and all costs incurred in the development of the subject premises for public use. -2- EXHIBIT C-2
