CITY OF ANOICA <br /> <br />CONTRACT FOR FIRE <br /> PROTECTION <br /> <br /> YEAR 1983 <br /> <br /> ITIII5 AGRE~NT, made and entered into by and between the City of Anoka, a <br /> ~unicipal Corporation, of the County of Anoka and State of Minnesota, party of the <br /> first part, hereinafter referred to as the "City", and the City/Township of <br /> in the County of Anoks , State of Minnesota, party of the <br /> WI~ESSETH: <br /> <br /> IThat in consideration of the sum of Twenty seven thousand, two hundred thirty eight <br /> <br /> __ d 42/100 ($27,238.42) Dollars per year, payable in advance by second <br /> party to said City, said City agrees to furnish fire service'and protection to the <br /> <br /> Iproperty located in said City/Township of R~m~y , for the compensation <br /> and on the conditions hereinafter set forth, and the said City further agrees that <br /> when called to propeyty located in the City/Township of R~oy , its <br /> <br />ifiremen will make a reasonable effort to attend fires on said property, PROVIDED, <br />IIOWEVER: <br /> <br /> 1. That the road and weather conditions be such that the fire run can be <br /> made with reasonable safety to men and equipment, and the decision of' the Anoka <br /> <br /> I Fire~ Chief or other fire department officer in charge shall be final in such matter. <br /> 2. That in the event that all fire apparatus and all members of the Anoka <br /> <br /> Fire Department are busy at the time a call comes in from said second party, the <br />IAnoka Fire will call for mutual aid and other that be <br /> Department <br /> any <br /> help <br /> m/ght <br /> <br /> availabl~because of the emergency or disasterous nature of the situation. However <br /> <br /> if all means of providing service are exhausted, and in the discretion of Anoka City <br /> I offic~als and Fire Chief or other fire department officer in charge, such <br /> apparatus <br /> <br /> snd members of said fire department are needed in Anoka, the City shall be held free <br /> and relieved from all liability to make said run or to respond to said call. <br /> 3. In the event the Anoka Fire Department is fighting a fire in the City/ <br /> <br /> Township of Ramsev and a fire breaks out in the City of Anoka, the A-noka <br /> <br /> Fire Department will not leave the City/Township Ramsay fire unattended. <br />IThe Anoka Fi~e Department will either remain to fight the fire or will provide ser- <br />vices from another municipality through mutual aid agreement. <br /> <br /> 4. If for any reason the Fire Chief or other fire departmen~ officer shall <br />I decide that no equipment or fire fighters can be spared, the decision of the Fire <br /> <br /> Chief or other fire department officer shall be final. <br /> <br /> 5. That said City shall not be liable in any way to the second party or to any <br /> other person, firm or corporation for failure of the Department of said City to at- <br /> tend a fire or to extinguish a fire or for any damage to or loss of goods, or for <br /> any act, omission, or for any other reason. <br /> <br /> 6. That in addition to the above mentioned sum of $27~238.42 <br /> <br /> Dollars per year, said second party <br /> agrees to pay as compensation for services rendered hereunder, the actual cost of <br /> each run made by the Fire Department to said City/Township when called by said <br /> second party or when made for the benefit of said second party or when made to a' <br /> place w~thin the boundaries of said second party, ~aJd sum to be paid when hilled <br /> by City. Said cost of run to be based on the following schedt~le: <br /> <br /> One lhmdred F£fty and no/]00'($150.00) per run for the first hour <br /> or fr:~ct]ot~ Lhereo£. <br /> <br /> Sixty and no/lO0 ($60.00) for each additional one-half hour or <br /> fraction thereof. <br /> <br /> <br />
