Harold Phelps is requesting a variance to the subdivision ordinance. ~e re,est, if authorized, would permit him to build a single f~ily residence on a 30 acre parcel with the only access being an easement granted by the adjoining property o~er to Avenue ~. 177th l There are situations similar to this in the City where the requests have been approved as well as situations where they have been denied. / ~is has been reviewed by the Pla~ing and Zoning Commission and they recommended ~ denying the request based on their findings of fact. ~e following ite~ are included as enclosure (D2-d) for yo~ consideration in this matter: 4 ~~~' . ~ a) ~. CASE #7: PETITION FOR PUBLIC UTILITIES; CASE OF MR. ART ~UDIO AND MR. NO~ HO~: The a~ve referenced property owners, along with a few other individuals, have petitioned for tr~k availability to their properties in the southeast corner of the City. If your intent is to only serve and assess those specific proper-i : .~~ ties on the petition, then you co~d assume that the project is petitioned for by 100% of the affected property o~ers. However, this wo~d prob~ly not be wise so we would recommend that you merely note you have received the petition and proceed with a City initiated project requiring a 4/5 vote. ~is then not only mandates the need for p~lic hearings, but also requires a ~tter unification of the City Council on an issue that I will have a long te~ impact on the City. ~ satisfy the requirements of the petition and the needs of the area to accommodate development, it will be necessary to adopt a resolution directing the City Engineer to prepare feasibility studies for the following items: ~ a) Trunk sanitary sewer b) Trunk storm drainage c) Trunk watermains and related structures (Wells, etc.) The City Engineer's letter regarding this issue is included as enclosure (D2-e). Council Action: If you want to proceed with this, your action will be to'~adopt the proposed resolutions ordering preparation of report on the proposed-pr0jects.
