The Board compares the preliminary areas on the basis of <br />certain predetermined factors and selects as proposed areas those <br />areas that seem. most suitable. <br /> <br />3. Public hearings are held for each proposed area; <br /> <br /> 4. The hearing examiner's report is submitted to the WMB; <br /> <br /> 5. The WMB reviews the hearing examiner's findings and <br />recommendations and the record of the hearing; and, <br /> <br /> 6. The WMB.makes its final decision on the areas to be <br />included in the °processing~."facility inventory. <br /> <br /> The Board's final decision on the inventory will be based on <br />the data deVeloped by the WMB staff and submitted as part of the <br />h.earing record, testimony of witnesses at the hearing, exhibits <br />submitted at the hearing and any other material included in the <br />record of the hearing. <br /> <br /> Copies of ~he criteria the WMB utilized to select the <br />proposed areas for 'hazardous waste.' processing facilities in the <br />Twin Cities metropolitan area wil~' be available at the time the <br />hearing is noticed. In addition, a report containing the basis <br />for the board's decision to propose an area for inclusion in its <br />inventory will be available prior to .the hearing. To the extent <br />feasible, these documents may be copied. PLEASE BE ADVISED that <br />it may not "be possible to copy certain documents such as large <br />maps. PLEASE BE ADVISED that this. hearing .is neither a contested <br />case hearing nor a rulemaking hearing. Therefo're, the procedural <br />rules applicable to contested case and rulemaking hearings are <br />inapplicable. The following procedur, es shall be followed: . <br /> <br /> 1. The hearing will be opened by the hearing examiner who <br />will explain the hearing procedures. <br /> <br /> 2. The WMB staff will 'introduce the jurisdictional documents, <br />the WMB criteria, and the report containing the basis for <br />proposing the area for inclusion in the Board's inventory. <br /> <br /> 3. The ~B 'staff will' briefly summarize the basis for <br />including the proposed area in...the inventory. <br /> <br /> 4.' Members of the public 'wilI~ be giVen an-Opportunity to make <br />oral statements, to offer written 'documents into the record and to <br />direct questions to the WMB st~ff~~ Representativ. es of the WMB <br />staff may address questions to members of the public. <br /> <br /> 5. The hearing examiner may exclude testimony which is <br />irrelevant, immaterial, or unduly repetitious. In addition, the <br />hearing examiner may disallow questioning which is irrelevant, <br />immaterial, unduly repetitious, argumentative, harassing, or <br /> <br /> <br />
