If the attorney <br />believes further investigation is warranted, a detailed <br />written request will be sent to'the city detective with <br />copies to the police chief. If the attorney declines <br />to issue a complaint, copies of the reasons for denying <br />the complaint will be sent to the city detective, police <br />chief, and Captain Hoogestraat of the MCIU. <br /> <br />COMPLAINT ISSUED - The city detective will be listed as <br />the complainant when the complaint is drafted. The detec- <br />tive will be notified by a secretary in the County Attorney's <br />Office when the complaint is prepared and ready to be <br />signed by a judge. The city detective will come to the <br />County Attorney's Office and pickup the complaint and proceed <br />to a judge~ Immediately after the comPlaint is signed, <br />the city detective will return the signed complaint to <br />the Criminal Division secretary who will make arrangements <br />to have the complaint filed with the Court. At this point <br />the city detective should be prepared with a date to <br />summons the defendant into court. When the city detective <br />Picks up the cpmplaint for signing, he will also be given <br />a bail evaluation sheet to be filled out in determining <br />any significant factors which would aid the court in setting <br />bail on the defendant. If the defendant fails to appear in <br />court on the day summoned, the County Attorney's Office <br />will notify the city detective. Although the warrant will <br />be placed in the computer, it will be the primary responsi- <br />bility of the city detective to locate the defendant and <br />execute the arrest warrant. <br /> <br />INTERVIEW OF THE DEFENDANT - The city detective will have <br />the responsibility for. attempting to interview the defendant <br />during the course of his investigation, or document why the <br />interview could not take place. When a complaint is issued <br />and the defendant is arrested, it will be the city detec- <br />tire's responsibility to interview the defendant. The jail <br />will call the city detective when a defendant has been <br />arrested on a complaint. An attempt to interview the <br />defendant must be performed by 9:00 a.m. of the morning <br />following the arrest. MCIU duty investigators will not be <br />interviewing defendants arrested on complaints where the <br />city detective is the complainant. The city detective will <br />also be responsible for having a defendant's confession <br />typed, signed by the defendant, and three copies given to <br />the.County Attorney's Office to be included in the case file, <br />and providing a copy to the defendant.' <br /> <br />OMNIBUS HEARINGS - The County Attorney's Office will send <br />a notice to the city detectiv~ concerning the date and time <br />of the Omnibus Hearing. The city detective will then check <br />with the Assistant County Attorney who is handling the case <br />to determine which witnesses will be required at the Omnibus <br />Hearing. The detective will then make the necessary arrange- <br />ments for the witnesses to appear. <br /> <br />-2- <br /> <br /> <br />
