I <br />! <br /> <br />I <br />I <br /> I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />il <br /> I <br /> I <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />December 28, 1982 <br /> <br />TO: <br /> <br />FROM: <br /> <br />City Police Chiefs and Detect,ives in Anoka County <br /> <br />Michael Roith, Head of Criminal operations, <br />Anoka County Attorney's Office <br /> <br />SUBJECT: PROPOSED STANDARD OPERATING PROCEDURE FOR PRESENTING FELONY · CASES TO THE ANOKA COUNTY ATTORNEY BY CITY DETECTIVES <br /> <br />SCOPE - City detectives, with prior approval from their police thief, <br />~ill have the option of preparing case files on felony property crimes <br />in which no one is in custody and no arrest is imminent. City detecL <br />rives will also have the option of preparing the case files on gross <br />misdemeanors involving Fleeing Police Officer; Pistol Without Permit; <br />Deer Shining; and Obstruction of Legal Process; if no one is in custod~ <br />and no arrest is imminent. Crimes against the person, defendants <br />· arrested on PC'or detained in'the jail, regardless of the charge, <br />will continue to be handled by,the MCIU investigators. <br /> <br />SUBMISSION OF THE CASE FOR A C6MPLAINT - If the city detective <br />chooses to handle the investigation of A felony property crime, <br />the following procedures will apply in obtaining an arrest warrant <br />and complaint. <br /> <br /> 1. Three complete copies, and a partial copy for filing .with <br /> the Court, of the case file will be forwarded to Captain <br /> Hoogestraat of the MCIU for initial review. A complete <br /> case file will contain copies of all the police reports, <br /> witnesses'~statements, a table of contents, a list of <br /> witnesses; a uniform case cover sheet, and a closing <br /> statement by the city detective concerning the case. <br /> Attached'to this memorandum is a sample copy of the required <br /> format for organizing the case file. Any file not organized <br /> in this format, or missing any of the forms, will auto- <br /> matically be sent back for completion. The city detective <br /> will retain a copy of the file for his own records. If <br /> the case file is complete and needs no additional investi- <br /> gation, Captain Hoogestraat will forward the file to the <br /> County Attorney's office. If the case' file is incomplete; <br /> needs further investigation; or the evidence does not <br /> support prosecution; Captain Hoogestraat will return the <br /> file to the detective, for the appropriate action. <br /> <br />e <br /> <br />The cases received from Captain Hoogestraat will be given <br />to Michael Roith to assign to a particular Assistant <br />County Attorney for review. ~'~en the case is assigned <br />to a particular attorney, the city detective will receive <br />notice of who will be handling the case and further <br />inquiries concerning that case should be directed to <br />that Assistant County A~torney.
