I I I I I I I I I I I il I I MEMORANDUM DATE: December 28, 1982 TO: FROM: City Police Chiefs and Detect,ives in Anoka County Michael Roith, Head of Criminal operations, Anoka County Attorney's Office SUBJECT: PROPOSED STANDARD OPERATING PROCEDURE FOR PRESENTING FELONY · CASES TO THE ANOKA COUNTY ATTORNEY BY CITY DETECTIVES SCOPE - City detectives, with prior approval from their police thief, ~ill have the option of preparing case files on felony property crimes in which no one is in custody and no arrest is imminent. City detecL rives will also have the option of preparing the case files on gross misdemeanors involving Fleeing Police Officer; Pistol Without Permit; Deer Shining; and Obstruction of Legal Process; if no one is in custod~ and no arrest is imminent. Crimes against the person, defendants · arrested on PC'or detained in'the jail, regardless of the charge, will continue to be handled by,the MCIU investigators. SUBMISSION OF THE CASE FOR A C6MPLAINT - If the city detective chooses to handle the investigation of A felony property crime, the following procedures will apply in obtaining an arrest warrant and complaint. 1. Three complete copies, and a partial copy for filing .with the Court, of the case file will be forwarded to Captain Hoogestraat of the MCIU for initial review. A complete case file will contain copies of all the police reports, witnesses'~statements, a table of contents, a list of witnesses; a uniform case cover sheet, and a closing statement by the city detective concerning the case. Attached'to this memorandum is a sample copy of the required format for organizing the case file. Any file not organized in this format, or missing any of the forms, will auto- matically be sent back for completion. The city detective will retain a copy of the file for his own records. If the case file is complete and needs no additional investi- gation, Captain Hoogestraat will forward the file to the County Attorney's office. If the case' file is incomplete; needs further investigation; or the evidence does not support prosecution; Captain Hoogestraat will return the file to the detective, for the appropriate action. e The cases received from Captain Hoogestraat will be given to Michael Roith to assign to a particular Assistant County Attorney for review. ~'~en the case is assigned to a particular attorney, the city detective will receive notice of who will be handling the case and further inquiries concerning that case should be directed to that Assistant County A~torney.
