Council Action. Following the inspection of the lot or lots to be <br /> divided or consolidated, the Building Inspector shall cause the <br /> application to be placed upon the agenda of the City Council for the <br /> next regular meeting of the Council following such inspection. The <br /> Building Inspector shall transmit to the City Council the application <br /> and all materials relatd thereto with his recommendation with respect <br /> to the application including any reports by professional consultants as <br /> deemed necessary. <br /> <br />6. Building Permits. No building permit shall be issued for the <br /> construction of a structure on lots or tracts divided or consolidated <br /> contrary to the provisions of this subsection. <br /> <br />170.0318 VARIANCES <br /> <br />170.0318A HARDSHIP <br /> <br />The City Council may adopt a resolution to grant a variance from the <br />requirements of this chapter as to specific tracts of land where it is shown <br />that by reason of topography or other physical conditions, strict compliance <br />with these requirements could cause an exceptional and undue hardship to the <br />enjoyment of a substantial property right, provided that a variance may be <br />granted only if the variance does not adversely affect the spirit and intent of <br />this chapter._ _ <br /> <br />170.0318B PROCEDURE <br /> <br />Written application for a variance shall be filed with the Zoning Officer on <br />forms supply by the City and shall state fully all facts relied upon by the <br />applicant- The application shall be supplemented with maps, plans or other data <br />which may aid in an analysis of the matter. The application shall be referred <br />to the Planning Commission for its recommendation and written report to the City <br />Council for its final action. A fee shall be charged for variance applications <br />as set by City Council resolution. <br /> <br />170.0318C CITY CouNCIL ACTION <br /> <br />No variance shall be granted by the City Council unless it shalI have received <br />the majority vote of the Council. The City Council shall make written findings <br />and conclusions of its action on the variance application, which findings and <br />conclusions shall be recorded in the Council's official minutes. <br /> <br /> <br />
