Following the inspection of the lot or lots to be divided or consolidated, the Building Inspector shall cause the application to be placed upon the agenda of the City Council for the next regular meeting of the Council following such inspection. The Building Inspector shall transmit to the City Council the application and all materials relatd thereto with his recommendation with respect to the application including any reports by professional consultants as deemed necessary. Building Permits. No building permit shall be issued for the construction of a structure on lots or tracts divided or consolidated contrary to the provisions of this subsection. 170.0318 VARIANCES 170.0318A HARDSHIP The City Council may adopt a resolution to grant a variance from the requirements of this chapter as to specific tracts of land where it is shown that by reason of topography or other physical conditions, strict compliance with these requirements could cause an exceptional and undue hardship to the enjoyment of a substantial property right, provided that a variance may be granted only if the variance does not adversely affect the spirit and intent of this chapter~_ _ 170.0318B PROCEDURE Written application fo~ a variance shall be filed with the Zoning Officer on forms supply by the City and shall state fully all facts relied upon by the applicant. The application shall be supplemented with maps, plans or other data which may aid in an analysis of the matter. The application shall be referred to the Planning Commission for its recommendation and written report to the City Council for its final action. A fee shall be charged for variance applications as set by City Council resolution. 170.0318C CITY COUNCIL ACTION No variance shall be granted by the City Council unless it shall have received the majority vote of the Council. The City Council shall make written findings and conclusions of its action on the variance application, which findings and conclusions shall be.recorded in the Council's official minutes.
