Organization shall have the authority as follows: The'authority to prepare and adopt a Watershed Management Plan meeting the requirements of M.S. ~473.878. I I I I I I I I Bo The authority to review and approve local water management plans as provided in M.S. ~473.879. C. · The authority of a Watershed District under Minnesota Statutes, Chap. 111, to regulate the use and develop- ment of the land when one or more of the following conditions exist: ' 1) Local government unit exercising p~anning.and zoning authority over land under section~ M.S. §366.10, 2366.19, 394.21, 394.37 or 462.351 tO 462.364, does not have a local water management plan approved and adopted in accordance with the requirements of ~473.879 or has not adopted the implementation program described in the plan. 2). An application to the local government, unit for a permit for the use and development of land, required and limited to, a variance from, the adopted local water management plan or implementation plan of the local unit.. 3) The local government unit has authorized the Organization to require permits for the use and development of the land. I I I I Other powers necessary to exercise the authority under clauses A through C including the power to enter into contracts for the performance of functions with governmental units or persons. 3.2 E__mployment': The Organization may contract fog services, may utilize existing staff of the parties, and may employ such other persons as it deems necessary. Where staff services of the party are utilized, such services shall not reduce the financial I II II commitment of such party to the operating fund of the Organization unless the Organization so authorizes, where the utilizati.on.?f staff services is substantial. 3.3 Committees: The Organization may. appoint such committees -5-
