City Attorney Goodrich replied that it was not necessary to obtain a right-of- way easement from the Orozco's, that only a drainage easement is needed from them and that has not been negotiated or obtained. Councilmember Cox asked Mr. Raatikka if he was sure that Class 5 had been applied to this road. Mr. Raatikka replied that he was sure it had been. Mr. Raatikka also stated that he would reinspect the culverts. Case #5: Adoption Of Resolution Adopting Assessments For Street Improvement Project #82-6 (Bowers Drive - Bowers Mississippi Acres): Motion by Councilmember Van Wagner and seconded by Mayor Gamec to adopt Re~olution ~82-146, Adopting Assessments for Street Improvement Project (Please refer to resolution file for Resolution #82-146). Councilmember Cox inquired as to what should be done about number of units to be assessed to Mr. Burt Dahlman and Mr. Ervin Tolkinen. Mr. Schnelle replied that a Findings of Fact should be prepared and if a reduction in assessments is approved for Mr. Dahlman and/or Mr. Tolkinen, the City would either have to absorb the costs or reassess the project. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Cox, Reimann and Van Wagner. Voting No: None. Motion by Mayor Gamec and seconded by Councilmember Cox authorizing City Staff to prepare a Findings of Fact for Mr. Bert Dahlman and Mr. Ervin Tolkinen, to be available for Council review at their next regular meeting. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Cox, Reimann and Van Wagner. Voting No: None. Case ~6: Adoption Of Resolution Adopting Assessments For Street Improvement Project #82-7 (.Bowers Drive - Bowers 2ns): Motion by Councilmember Van Wagner and seconded by Mayor Gamec to adopt Resolution #82-147, Adopting Assessments for Street Improvement Project 982-7. (please refer to resolution file for Resolution #82-147). Motion carried: Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Cox, Reimann and Van Wagner. Voting No: None.
