I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> i <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />City Engineer Raatikka stated that the County Highway Dept. is willing to <br />correct the problem, but that the County Attorney has gotten involved in <br />condemnation. <br /> <br />Mr. Hendriksen replied that' all he is requesting is that the County keep <br />the water in the ditch and off his property and that he has offered the County <br />an easement. <br /> <br />Mr. Raatikka replied that the County will take care of the water problem, <br />but there is also water coming onto Mr. Hendriksen's property from the north -- <br />157th. <br /> <br />Councilmember Cox stated that tonight Council is only discussing water coming <br />from the south onto Mr. Hendriksen's property. <br /> <br />Councilmember Van Wagner stated that the County has combined condemnation and <br />water intrusion. <br /> <br />Mr. ~endricksen objected strongly. He stated that the County refuses to <br />address water intrusion. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Reimann authorizing <br />City Engineer meet with Mr. Hendriksen and County Staff in order to reach <br />a solution to the water intrusion problem which will benefit the County road, <br />Mr. Hendriksen and the City of Ramsey. <br /> <br />Further Discussion: Mr. Hendriksen stated that Council took this'same action <br />two months ago, it is almost winter time now and if the problem isn't <br />corrected my barn will be flooded this spring. Mr. Hendriksen stated that <br />it is now a legal problem. Mayor Gamec replied that if it is a legal problem, <br />then Mr. Hendriksen should have his attorney contact the County attorney, <br />further that Mr. Hendriksen is requesting the City to fight his battle. <br />Mr. Hendriksen replied that the County should not be allowed to turn their <br />backs on the problem that they have caused. Councilmember Cox replied that <br />the City knows the problem, we should try and handle it and that Mr. Raatikka <br />has been directed to contact the County and try to reach a solution and <br />that Mr. Hendriksen cannot expect the City Council to go any further than that. <br />Mayor Gamec requested that Mr. Raatikka report back to Council at their <br />special meeting on November 3, 1982. <br /> <br />Motion carried. Voting.Yes: Mayor Gamec, Councilmembers Sorteberg, Reimann, <br />Cox and Van Wagner. Voting No: None. <br /> <br />Motion by Mayor Gamec and seconded by Councilmember Van Wagner to'schedule <br />a special Council Meeting for Wednesday, November 3, 1982 at 5:00 P.M. <br />to canvass the ballots and discuss progress on Mr. Terry Hendriksen's water <br />intrusion problem. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg, Cox, <br />Van Wagner and Reimann. Voting No: None. <br /> <br />b) 167th Avenue NW Proposed Extension: <br /> <br />Mr. Raatikka reviewed his letter of October 20, 1982 regarding 167th Avenue <br />NW from C.S.A.H. 5 to Jasper Street NW. with Council. <br /> <br />¢ouncilmember Van Wagner inquired as to why the City would be upgrading this <br />section. <br /> <br />C/October 26, 1982 <br /> Page 12 of 18 <br /> <br /> <br />
