I <br /> I <br />I <br />i <br />I <br /> I <br /> 1 <br />I <br />I <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />In accordance with City Ordinance, the Planning and Zoning Commission conducted <br />a public hearing on this request at their meeting of November 3, 1982 as well <br />as considered the request during their regular meeting of that evening.. They <br />found that the application was almost entirely deficient and therefore tabled <br />the matter. <br /> <br />The City Staff's review had not been so criticial., as'~we felt the proposal sub- <br />mitted was adequate to deserve consideration. <br /> <br />To avoid any further controversy, we have asked the City Engineer to prepare <br />his unbiased report on the application in strict compliance with the requirements' <br />of the Ordinance. <br /> <br />It must be noted that Ordinance also requires that you must take action to either <br />deny or approve the request within thirty days of the Planning and Zoning Com- <br />mission review. Further, said action must be supported by findings of fact. <br /> <br />The following items are included as enclosure (D2-?) for your consideration in <br />this matter: <br /> <br />a) Applicant's application <br />b) Applicant's undated letter of application <br />c) Applicant's letter of September 30. 1982 <br />d) Public hearing notice and affidavit of publication <br />e) List of property owners notified <br />f) Area location map <br />g) Structure floor plans <br />h) Building Official's memo 3- dated October 13, 1982 <br />i) Planning and Zoning Commission public hearing minutes of November 3, 1982 <br />j) Planning and Zoning Commission regular minutes of November 3, 1982 <br />k) City Engineer's review dated December 15, 1982 <br />1) Partial findings of fact for Council completion <br /> <br />The conceptual drawings, site plan and topography will be available at the meeting <br />for your review. <br /> <br />It should be noted that additional constraints can be placed on this development <br />through a development contract covenant agreement which you will need in this <br /> <br />case. <br /> <br />Council Action: Your action in this matter will be to adopt findings of fact <br />and recommend approval/denial/tabling the request. The following proposed motion <br />is hereby submitted for your consideration: ~ <br /> Motion by ~. (~ ! and seconded by t3/t'~ :'~; ' to adopt the findings of <br /> fact for the urban development permit~ request for the Ramsey Commons plat.. <br /> <br /> Motion carried. Voting yes ~.~? ~-- . <br /> Voting no <br /> <br />You will also have to approve/disapprove of the urban development contract. You <br />do want a covenant agreement on said development. This project will be your <br />first one of its kind in your front yard so you want to give it thought. Now, <br />if you deny it, then you don't have to be concerned about it but you better have <br />your reasons for denying the urban development permit well documented in the <br />Council proceedings.
