Per- <br />mission to develop specific parcels of land under the provisions which <br />follow shall he binding on all construction. Any proposed change in <br />the development plan af':er approval by the city council shall be resub- <br />mitted for consideration. The land use, minimum ]or area, yard, b~ight <br />and accessory uses determined by the pJanned unit development require- <br />merits sha~l prevail, over conflicting requirements listed elsewhere <br />within th~s code. <br /> <br />PtOH, IHINARY DEVELOPMENT PLAN PROCEDURE <br /> <br />An applicant for a planned unit development shall submit a preliminary <br />development plan to the zoning officer with a written statement and a <br />certified check or money order in an amount to cover all the costs <br />incurred ~n checking and processing such plans. <br /> <br /> 1. Within sixty (60) days after the filing of the preliminary <br />plan w~th the zoning officer, the planning commission shall forward the <br />plan to the city council with a written report recommending that the <br />plan be disapproved, approved, or approved with modifications, stating <br />the reasons for these recommendations. <br /> <br /> 2. WJ. thin forty-five (45) days after the receipt of the <br />application by the city council, a public hearing shall be held by <br />the city council on the application. Tbe city council may continue <br />the hearing or refer the matter back to the planning commission for <br />further study; provided, however, that the public hearing or hearings <br />shall be conclnded within forty-five (45) days after the date of the <br />f~rst public bearing, unless the applicant shall consent in writing to <br />an extension of the time. Upon conclusions of all_ hearings, the city <br />council shall within thirty (30) days make and file findings and cause <br />a copy th'ereof to be mailed to the applicant. <br /> <br /> 3. In the event tentative approval is granted subject to <br />conditions, the applicant shall, within forty-five (45) days after <br />receiving a copy of the findings of the c~ty council, notify the <br /> <br /> <br />
