A copy of the notice and a list o! the owners <br />and addresses to which the notice was sent shall be attested to by <br />the zoning officer and shall be made a part o~ the records ot the <br />proceedings. The failure to give mailed notice to individual <br />property owners, or delects in the notice, shall not invalidate <br />the proceedings, provided a bona fide attempt to comply with this <br />section has been made. <br /> <br /> 4. If, after any public hearing held upon an amendment, <br />the proposed amendment is revised or further revised to include land <br />previously not affected by it, the city council shall bola another <br />public hearing, pursuant to public notice, before proceeding to vote <br />on the amendment. <br /> <br /> 5. The c~ty council sball act upon the request within <br />forty-fSve (45) days after the last public hearing has been held. <br /> <br /> 6. ^ four-fifths (4/5) affirmative vote of the city council <br />shall be r~.quired for passage of any amendment to this chapter. <br /> <br />170.01 10 AI),XlINISTRATIUN AND ENFORCF~.IENT <br /> <br />1_70.0110A ZONING OI:}:ICER <br /> <br />The zoning officer, who shall be appointed by the city council, shall: <br /> <br /> a. Administer and enforce the provisions of this chapter <br /> in accordance with its litera± terms and shall not <br /> have the power to permit any construction or any <br /> use or change of use which does not conform to this <br /> chapter; <br />b. Issue zoning certificates, building permits, and <br /> temporary conditional use permits; <br />c. Maintain a permanent file of all zoning certificates <br /> and applications as public records. <br /> <br />170.0110B ZONING CERTIFICATES <br /> <br />t zoning certificate or Urban Development Permit, if 'subject property <br />is in a "U" district, shall be obtained before any person may: <br /> <br />a. Occupy or use any vacant land; or <br />b. Occupy or use any structure hereafter constructed, <br /> reconstructed, moved, altered or enlarged; or <br />c. Change the use of a structure.or land to a different <br /> use; or <br />d. Change a non-conforming use. <br /> <br />Applications for a zoning certificate shall be accompanied by a plot <br />plan showing clearly and completely the location, dimensions and nature <br />of any structure involved and suoh other information as the zoning may <br />require for administration of this ordinance, together with a filing <br />fee in accordance with a schedule annually affixed by resolution of <br />the city council. Applications for an Urban Development Permit shall <br />be in accord with Section]70~15 herein. <br /> <br /> <br />
