I
I
I
I
I
I
I
I
I
I
I

I
I
I
I
I
I
I

To: L]oyd Schnelle
From: Chief ^uspos
Re: Insurance Co. payment from Gustafson's accident

This note will, I hope, explain the rationale behind my request to be
paid for hours worked, from the insurance company settlement regarding
Officer C, ustafson's accident with the hit-run driver.
At the time Dave was out of work I attempted to schedule the available of-
ficers and myself to cover his absence. In doing so I considered the pos-
sibi. lity of recouping our overtime losses during this period by billing
the insurance company since theif insured caus&d the ultimate expenses.
I consulted with Bill Goodrich and though he doubted we would have stand-
5rig to collect he suggested we go ahead and try when the time came. Keeping
in mind that they would likely not cover the overtime expenses I scheduled
myself for many hours so that the city ~¢ould not be out too much overtime
costs as I could only collect comp. time. I also had it in mind ~hat if
the insurance company would pay that I could be reimbursed out of that
check since it wouldn"t in effect or in actuality be corning from the city
budget. It turned out that the insurance company did pay for all pay costs
incurred by the city during Officer Gusta£son's absence.
I have therefore submitted the list of costs showing nv/ pay scale at time
~md a half for the number of hours worked. I do not feel that this is set-
ting a precedent regarding paying department heads overtime since the in-
surance company is paying the bill and is actually only paying me for my time.
Be assured that if in fact the insurance company had elected not to pay for
the expenses we submitted I would be accepting the comp. time that I now have ..~
and would not be asking for payment as I .know .and accept the ruling not to .
pay overtime to deparment heads.
/
//,."~sPe~i~d'
t
~i]~e Auspos ~]~
